February 18, 2011 -- Professor Kenneth Klee commented on a lawsuit filed by former Chrysler dealers against the U.S. Department of Treasury. His comments appear in a Cleveland Plain Dealer article.
Kenneth Klee, a bankruptcy law professor at the University of California Los Angeles, said the government didn't seize property from dealers when it pushed for Chrysler to cancel their contracts. It exercised Chapter 11 Bankruptcy rules that allow debtors to cancel contracts.
"My guess is that they just have contract rights, not property rights," Klee said. "That's what the case will have to turn on."
