June 17, 2011 -- Professor Eugene Volokh commented on complaints by House Republicans that President Obama used an autopen machine to sign legislation extending the Patriot Act. His comments appear in a New York Times blog article.
Eugene Volokh, a constitutional law professor at the University of California, Los Angeles, disagrees.
“It’s an interesting, interesting letter,” Mr. Volokh said, but added, “In that very same sentence of Article I it also says if he does not approve the law, ‘he shall return it,’ and no one thinks he has to walk down Pennsylvania Avenue to do that. They recognize return need not be personal return.” Mr. Volokh, who considers himself on “the conservative side of the conservative/liberal debate on text,” said constitutional text alone rarely resolved interpretive matters.
