September 8, 2014 – Professor Katherine Stone commented on the recent Court of Appeals ruling in the Alexander v. FedEx case in an article in The Information.
“These cases are going to keep coming up and the devil is always in the details. As the FedEx opinion makes clear, just calling someone an independent contractor doesn’t make it so,” says (Stone). “As to its application to AmazonFresh and Uber, that will depend how closely those companies' arrangements with their staff look like those at FedEx. There probably will be a lot of intermediate cases that will have to be re-visited.”
