July 8, 2015 -- Professor Jill Horwitz commented on the loss of tax exempt status for a New Jersey hospital and discussed PILOT programs, which allow nonprofits to acknowledge the benefits they receive from local governments while avoiding the additional stress of taxation. Her comments appear in a Law360 article.
“Local municipalities are under a lot of budgetary pressure,” said UCLA Law professor Jill Horwitz, “If you have one with a lot of tax-exempt properties, they will likely try to seek some attention.”
Professor Horwitz says nonprofits across the country are increasingly negotiating payment agreements, in addition to paying fees for police and fire protection. She cites institutions like Harvard University and the Massachusetts Institute of Technology, which utilize PILOT programs in the Boston area.
