December 8, 2015 – Professor Adam Winkler commented in Business Insider on Fisher v. Texas, an affirmative action case currently before the U.S. Supreme Court. At stake is whether it’s legal for colleges to consider applicants’ race to ensure a diverse student body. This week marks the second time the high court has heard the case of Fisher v. Texas, which could have far reaching implications given that many colleges and universities specifically consider race in their admissions policies.
"Four justices have all but demanded that government forsake the use of race for purposes of diversity," stated Professor Winkler. "Justice Kennedy, the swing justice, has never voted to uphold a racial preference."
