April 20, 2016-- Professor Adam Winkler was quoted by The Washington Post in an article addressing Hillary Clinton’s claim about the limits of gun immunity law in the Sandy Hook families’ lawsuit. Clinton believes that gun makers and sellers should be legally responsible for shootings like Sandy Hook.
“Gun manufacturers typically try to get the case thrown out based on jurisdiction. If this maneuver fails (as in this case [Sandy Hook]), the next step is to use the immunity law and argue that the case doesn't qualify as an exception,” said Winkler. “At that stage, gunmakers have been successful in getting such cases dismissed.”
