April 18, 2016--Cara Horowitz, co-executive director of the Emmett Institute on Climate Change and the Environment, talked to Capital Public Radio about how questions arising from a suit against California’s cap-and-trade system could pose challenges for the California Air Resources Board. The California Chamber of Commerce and Morning Star Packing Company claimed that the cap-and-trade program is an unconstitutional tax.
“The questions suggest that the court might be inclined to use a standard for judging whether the auction is a tax that the state had argued against applying," said Horowitz.
