April 4, 2016 - Professor Eugene Volokh spoke to the San Francisco Daily Journal about the Supreme Court’s decision to deny hearing a free speech defense from Electronic Arts Inc. in a case involving the use of retired NFL player’s likeness in the popular John Madden Football video game franchise. Volokh expressed disappointment about the Supreme Court decision against the hearing, as he believes decisions on the issue of publicity rights are long overdue.
"There is a very solid split among federal and state courts on how the First Amendment extends to publicity rights," Volokh said.
