Lawyers have urged the U.S. District Judge to block the state from enforcing its cyber stalking law, as their client is facing prosecution for making online posts that were critical in nature —even though the posts were non-threatening. However, Volokh argued that the law ultimately criminalizes online speech intended to harass, torment, or embarrass others. By that definition, he told the judge, President Trump could be prosecuted for his posts about Hillary Clinton.
