Eugene Volokh Cited in New York Times on the Supreme Court Masterpiece Cakeshop Case

Professor Eugene Volokh was cited in a New York Times opinion piece regarding the ongoing Masterpiece Cakeshop v. Colorado Civil Rights Commission case. As the Supreme Court hearing is drawing near, the commentary points out two objections:  first, treating the cake as speech – especially cakes without writing - abuses the First Amendment, and second, whatever “speech” is involved is clearly that of the customer, not of the baker. As Volokh explains, “No one looks at a wedding cake and reflects, ‘the baker has blessed this union.’”
