Professor Samuel Bray was featured in the Daily Journal in a discussion of whether nationwide injunctions are too broad. Bray argues that the U.S. Supreme Court should limit the scope of national injunctive relief available in rulings by district court judges. “The best understanding of the evidence is that the national injunction went from being unthinkable to being thinkable without any sharp turns or decisive moment,” Bray writes.
