Peter Arenella Interviewed by New York Times about Prosecuting Insanity Defense

Professor Peter Arenella was interviewed by the New York Times about prosecuting insanity defense cases in light of the murder trial of a nanny who fatally stabbed two small children in her care. “Prosecutors are very adept at showing that the defendant engaged in some rational behavior, that they planned the attack in some way, or they did things to escape detection or made up a story,” said Arenella. “This shows that even if they were mentally ill, they still understood what was wrong.”
