KPCC Asks Sean Hecht: Who Should be Held Liable for Wildfires?

Professor Sean Hecht was interviewed on KPCC on who should be held liable for wildfires, given private utilities are held liable even if they’re not negligent, because of a legal doctrine called “inverse condemnation." "Strict liability creates a very strong incentive for those responsible to take a lot of precautionary measures. It motivates companies to make safer products than they otherwise would because they know that even if they didn’t technically do something wrong, if their product hurts somebody, they will be held responsible,” said Hecht.
