[EL] ELB News and Commentary 12/21/11

I would agree that "please don't run any ads!" doesn't raise coordination questions, but I, too, am flummoxed by whether it constitutes coordination for a candidate to say "don't run these three ads" when there's a fourth known ad as well. Is "don't run any negative ads" any different from "I really like the one about my economic plan, and folks should see it"?

Interesting story re Romney Super PAC and the coordination issue.
Click here: Former FEC head: Romney could tell PAC to stop ads | Campaign 2012 | Washington Examiner<http://campaign2012.washingtonexaminer.com/blogs/beltway-confidential/former-fec-head-romney-could-tell-pac-stop-ads/268251>
I agree with Trevor on the narrowness of the anti-coordination requirement, but I have always been perplexed by whether a candidate can ask an independent group not to run an ad. Trevor says ok. Jim

NPR listeners voted online on constitutional amendments<http://www.npr.org/blogs/itsallpolitics/2011/12/20/144016912/we-the-people-npr-readers-would-ratify-four-new-amendments?ft=1&f=1014&sc=tw> they would prefer (or not¨Can interesting list). What did they want? ¡°As of Dec. 20, you¡¯ve voted to abolish the Electoral College, to limit campaign contributions from corporations, to deny corporations the rights of citizens and to prohibit members of Congress from lobbying once they leave office. In our un-scientific sampling, ¡®ratification¡¯ required the support of two-thirds of voters. Romney channeling<http://electionlawblog.org/?p=26805> his finest Fred Wertheimer: ¡°But these kinds of associations between money and politics in my view are wrong. And for that reason I would like to have campaign spending limits. And to say we are not going to spend more than this in certain campaigns, in a campaign for Senator or U.S. Representative and so forth because otherwise I think you have money playing far too important a role. I also would abolish PACs. You probably have one. I don¡¯t like them. I don¡¯t like the influence of money whether it is business, labor, or any other group¨C I do not like them.¡±
