Regarding the Rick Perry situation.
If a candidate's team identifies the in-state circulator requirement early,
they might seek legal counsel. Here are the problems I would see if
consulted:
1. If we file suit early against the requirement, the defense will be that
we have shown no harm to the campaign yet because we have not even tried.
2. If we use in-state and out-state circulators, every signature gathered
by the latter is at risk. If we get the required gross number of
signatures, and those gather by the out-state circulators are thrown out,
we will face the defense that we could have used in-state people to gather
the same signatures.
3. If we use in-state circulators only, then we face the current Rick Perry
situation and the defense Rick Hasen has described.
Nobody said election law was easy!
