[EL] Why attacking super PACs won't work

I certainly agree with the headline (but don't tell the Dems that, I don't  
want them to stop trying), but I don't agree with this:
 
Fifty-one percent of those tested said super PACs didn’t help one candidate 
 more than the other — far more than the 16 percent who said they helped 
Romney  more and the 15 percent who said they aided Obama more. (The correct 
answer, of  course, is that _they have been helping Romney more — by a lot_

The question was about "outside groups" and I think the general public  
thinks everyone other than a candidate is an outside group.  This means  labor 
unions, advocacy groups, 527s, Super PACs, and maybe even political  parties 
and the media.  When you throw all of these together, the Reps are  only 
currently benefiting from the spending of Super PACs and maybe slightly by  
political parties.  Republicans are getting crushed by labor union and  media 
spending. No wonder the reformers are only really targeting  Super PACs.
 
This also gives me an opportunity to grip about the label "outside  
groups."  In other words, this label suggests that citizens are intruders  who 
interfere with elections.  Actually our system is based on the notion  that the 
election is held among the citizens so they are hardly outside the  process. 
 "Independent groups" would be more accurate and less of a  pejorative, but 
reformers like "outside groups" because they are the ones they  want to 
shut down, i.e. the citizens.  Jim

In the ever-evolving jurisprudence of campaign finance, one principle has  
endured: the rules governing candidate elections are analyzed differently  
from the rules governing ballot measures because the latter elections have  
been found not to implicate the state’s legitimate interest in combatting  
quid pro quo corruption. It should now be apparent to even a casual observer  
of the initiative process, however, that candidates are very involved in  
ballot measures; they use initiatives to influence turnout in elections in  
which they are also running, and they resort to initiatives to adopt policy  
change they cannot enact through the traditional legislative system. The  
clear relationship between candidates and direct democracy is formally  present 
in a context of growing salience: recalls. In this article, I use  recall 
elections as a way to consider the current state of campaign finance  
jurisprudence as it relates to all the mechanisms of direct democracy;  recalls 
provide a different framework to assess campaign finance rules  because they 
are explicitly hybrid elections, combining a ballot question  about the recall 
of an official and, sometimes simultaneously, the election  of a successor. 
Part I will lay out the structure of the recall process,  particularly in 
California and Wisconsin, the two states in which statewide  recalls of 
governors have shaken the political establishment and caught the  attention of 
the nation. Part II will analyze the constitutional issues  raised by campaign 
finance regimes that include contribution limitations  affecting recall 
elections, particularly in light of Citizens United v.  Federal Election 
Commission. Part III will extend this analysis and argue  that the conclusions 
reached about permissible regulatory structures in the  context of recalls 
implicate the way states and municipalities regulate  money in ballot measure 
campaigns generally.

statements about equality in campaign finance at the end of the paper are

The FCC has demonstrated the online portal for the broadcasters in recent  
weeks. The online system allows stations to simply drag and drop files onto  
the FCC’s web portal, or upload them via file-sharing programs such as  
DropBox. “We’re working hard to comply,” said Julie Hoover, a New York-based  
spokeswoman for ABC-owned stations. At one presentation, the chief of the  
FCC’s media bureau William Lake said, “We fully expect that the TV stations  
will find it easier, not harder, to use the new online filing system.”

[For] stations covered by the rule, ad buys made prior to [today] don’t  
have to be posted online, meaning that records of millions of dollars  already 
spent, much of it by groups do not disclose donors, will still be  
gathering dust in station file cabinets. Stations have six months to post  records 
of those ads. And stations outside the scope of the FCC order —  those not 
affiliated with the four major networks (including  Spanish-language stations) 
and those not in the 50 top broadcast markets —  don’t have to begin 
posting their public files online for another two  years. 
In addition, the files that the FCC does post this year will be in PDF  
format. That means users seeking to track the spending of particular  interest 
groups or campaigns potentially will have to sift through hundreds  of 
files. 
William Lake, the chief of the FCC’s media bureau, called putting the  
files in machine-readable format — which would enable easy searching,  sorting 
and downloading — a “long-term goal.” For now, the agency would rely  on 
third parties to “actively develop ways, including crowdsearching, to  make 
documents more searchable.”

Federal Election Commission to approve quickly a new advisory opinion that  could 
encourage wireless companies to allow campaign contributions by text  
messaging….
The FEC is set to discuss the issue at an Aug. 2 commission meeting,  but a 
vote on a new advisory opinion is not expected at the meeting. Further  
action by the commission could come in the days or weeks after the meeting,  
according to FEC officials….
According to memos filed by the FEC commissioners documenting “ex parte  
communications,” Bauer called the FEC’s three Democratic commissioners plus  
the commission’s Republican chairwoman, Caroline Hunter, in late July to  
urge prompt action. A memo from Democratic FEC Commissioner Ellen Weintraub  
said Bauer “stated his concern” that if the commission did not respond  
quickly, campaigns would not be able to receive contributions via text

For many years, especially since the 2000 presidential election  
controversy, scholars have debated whether nonpartisan actors should replace  partisan 
actors or a bipartisan commission in administering elections,  conducting 
redistricting, and policing the campaign finance system. Some  states 
recently have adopted more nonpartisan models, including California’s  
redistricting commission and Wisconsin’s Government Accountability Board,  although most 
states have retained partisan or bipartisan control. 
This symposium, sponsored by the _UC Irvine School of Law_ 
(http://law.uci.edu/) , the  _UC Irvine Law  Review_ 
(http://www.law.uci.edu/lawreview/index.html) , and the _UCI Center for the Study of  Democracy_ 
(http://www.democracy.uci.edu/)  will offer empirical, legal, normative, theoretical, and  
historical perspectives on the use of partisanship in the agencies governing  
election administration, redistricting, and campaign finance laws. How should 
 the success or failure of such institutions be assessed? Are nonpartisan  
agencies normatively preferable to partisan and bipartisan agencies in  
achieving the goals of the political system? What explains why jurisdictions  
adopt or fail to adopt nonpartisan institutions? The symposium will bring  
together leading scholars in the field of election law and political science  
to consider such questions in the weeks leading up to the presidential  
election of 2012.

early. There would be no more  witnesses for the state and only a few more 
witnesses for petitioners. I used  the bonus time to meet up with a local 
Republican strategist who’d been  following the hearings as close as everybody 
else and had a low opinion of  them. The theory: Any decision in the 
Commonwealth Court would be appealed to  the state Supreme Court. Why play your aces 
when you’ve got a higher-stakes  game coming up? Why not just let the 
anti-ID crowd put on a parade of sad  witnesses for the media?” 
But given the temporary 3-3 split on the state Supreme Court, there’s a  
decent chance the trial judge’s decision _would be final_

NOTE: This release has been revised to add the years  1992-1998 to the bar 
chart, while leaving the text of the release unchanged.  1992 was the first 
election with disclosure of soft money. The purpose of  the revision is to 
clarify the following point: 2000 and 2002 represented by  far the high 
points before McCain-Feingold for party fundraising (hard and  soft money 
combined.) After McCain-Feingold, the parties raised about as  much hard money at 
18 months between 2004 and 2010 as hard-and-soft money  combined in 2000. 
They also raised at least 50% more in hard money alone in  2004-2010 than in 
hard-and-soft money combined between 1992-1998. In 2012  the parties’ hard 
money at eighteen months exceeded hard-plus-soft in 2002.  The evidence 
therefore shows that national parties after McCain-Feingold  quickly rebounded in 
their hard money receipts alone to levels that equaled  or exceeded their 
historic levels of combined hard-plus-soft money.
