Sean is exactly right. I have spoken with Senator-elect Cruz (OK, jumping the gun, but c’mon) in the past, although not for quite some time, and I certainly don’t claim to speak for him. But my understanding of his position from those prior conversations, and having seen the interview in question, is that his position is the same as that of Mitch McConnell and pretty much all Republicans.
What has changed in this debate is not the Republican position, but the reform community’s new insistence on disclosure of things that have never been subject to disclosure.
Remember, there has been no legislation introduced in Congress to roll back any disclosure provisions. What there has been is legislation introduced to roll back what most people, following NAACP v. Alabama, Bates v. Little Rock, Thomas v. Collins, NAACP v. Button, and Talley v. California, had thought were constitutionally protected privacy rights.

Rick notes concerning Ted Cruz “What’s notable here<http://www.politico.com/news/stories/0812/80441.html> is the endorsement by a conservative Republican of disclosure, the way it used to be.”
Rick is exactly right - many conservative Republicans have in the past supported full disclosure of contributions to candidates. The mantra of disclosure is today being applied to something else, of course - private associations of citizens, businesses, unions, and other groups who are not coordinating with candidates. Whether one favors or disfavors the new disclosure regime being sought, it seems it should at least be acknowledged that it is different than what was proposed and supported in the past, and thus there’s not much reason to carp about alleged inconsistency or hypocrisy.

“Our Electoral Exceptionalism”<http://electionlawblog.org/?p=39447>

Nick Stephanopoulos has posted this draft<http://papers.ssrn.com/sol3/papers.cfm?abstract_id=2139123&> on SSRN (forthcoming U Chicago Law Review). Here is the abstract:
Election law suffers from a comparative blind spot. Scholars in the field have devoted almost no attention to how other countries organize their electoral systems, let alone to the lessons that can be drawn from foreign experiences. This Article begins to fill this gap by carrying out the first systematic analysis of redistricting practices around the world. The Article first separates district design into its three constituent components: institutions, criteria, and minority representation. For each component, the Article then describes the approaches used in America and abroad, introduces a new conceptual framework for classifying different policies, and challenges the exceptional American model.
First, redistricting institutions can be categorized based on their levels of politicization and judicialization. The United States is an outlier along both dimensions because it relies on the elected branches rather than on independent commissions and because its courts are extraordinarily active. Unfortunately, the American approach is linked to higher partisan bias, lower electoral responsiveness, and diminished public confidence.
Second, redistricting criteria can be assessed based on whether they tend to make districts more heterogeneous or homogeneous. Most of the usual American criteria (such as equal population, compliance with the Voting Rights Act, and the pursuit of political advantage) are diversifying. In contrast, almost all foreign requirements (such as respect for political subdivisions, respect for communities of interest, and attention to geographic features) are homogenizing. Homogenizing requirements are generally preferable because they give rise to higher voter participation, more effective representation, and lower legislative polarization.
Lastly, models of minority representation can be classified based on the geographic concentration of the groups they benefit and the explicitness of the means they use to allocate legislative influence. Once again, the United States is nearly unique in its reliance on implicit mechanisms that only assist concentrated groups. Implicit mechanisms that also assist diffuse groups-in particular, multimember districts with limited, cumulative, or preferential voting rules-are typically superior because they result in higher levels of minority representation at a fraction of the social and legal cost.
I read an earlier draft of this piece. Highly recommended.

“Facts Take a Beating in Acceptance Speeches”<http://electionlawblog.org/?p=39439>

This is a very important development<http://www.nytimes.com/2012/08/31/us/politics/ryans-speech-contained-a-litany-of-falsehoods.html> in campaigns about which I plan to write more:
The growing number of misrepresentations appear to reflect a calculation in both parties that shame is overrated, and that no independent arbiters command the stature or the platform to hold the campaigns to account in the increasingly polarized and balkanized media firmament. Any unmasking of the lies or distortions, the thinking goes, rarely seeps into the public consciousness.
But an interesting question unfolding is whether there is a tipping point at which a candidate becomes so associated with falsehoods that it becomes part of his public persona - which hampered Vice President Al Gore during his run for president in 2000, when his misstatements on the campaign trail were used to stoke the perception that he could not be trusted in general.

Today’s must read <http://www.businessweek.com/articles/2012-08-31/exclusive-inside-karl-roves-billionaire-fundraiser> from Bloomberg:
This rare look at the mechanics of SuperPac fundraising and electoral strategy was likely not intended for reporters. I was invited as the guest of a financier who is a significant Republican donor. The financier knew that I was a journalist. At no point was I presented with, nor did I agree to, restrictions regarding the information I heard. Upon my arrival at the breakfast, I was not asked if I was a journalist. I gave my name, identified the person who had invited me, was handed a wristband, and ushered into the dining room. American Crossroads disputes this version of events, but a spokesman did not immediately return calls to elaborate.

Sounds Like There Will Be No Emergency SCOTUS Action in the Texas Voter ID Case<http://electionlawblog.org/?p=39419>
Posted on August 30, 2012 3:33 pm<http://electionlawblog.org/?p=39419> by Rick Hasen<http://electionlawblog.org/?author=3>
Earlier today I wrote<http://electionlawblog.org/?p=39379> about how Texas, which had indicated an intent to appeal, could seek emergency relief from the Supreme Court to put its ID law into effect for November’s elections.
But now comes this from AP<http://hosted.ap.org/dynamic/stories/U/US_TEXAS_VOTER_ID?SITE=AP&SECTION=HOME&TEMPLATE=DEFAULT>: “State Attorney General Greg Abbott said he will appeal to the U.S. Supreme Court, “where we are confident we will prevail.” He also told the Associated Press late Thursday that there is now definitely not enough time to salvage the law for the November election.”
So we are just waiting on Pa. and South Carolina as states whose ID laws are on hold (and Wisconsin, if the Supreme Court takes up AG van Hollen’s invitation to look at this case again-very unlikely).

While the ruling in the Texas case today makes it marginally more likely that the South Carolina voter id law will be precleared (because it is not nearly as onerous as the Texas law), Ryan Reilly explains<http://tpmmuckraker.talkingpointsmemo.com/2012/08/voter_id_reasonable_impediment.php> the other reason why the federal court may not preclear South Carolina: it doesn’t seem to have a plan to implement a fair and reasonable voter id law in time for November.
