But I would prefer that contribution limits to candidates and political
parties be raised because these low contribution limits force money away from
them, thereby distorting the system and making it less accountable. Jim

attention, because it raises important and recurring issues which have never been
fully resolved about the relationship between the laws of bribery (and

_Oy Vey! Voter Fraud Allegations in Nevada GOP Caucus_

AP is _reporting_
(http://www.bellinghamherald.com/2012/02/01/2375805/gop-race-turns-to-nevada-amid.html) that the Romney and Paul campaigns are
worried about the possibility of voter fraud because there will be a
post-Shabbat (after sundown) special caucus meeting in Clark County, Nevada to
accommodate religious Jews who cannot participate in an earlier caucus this day.
It appears the concern is that some voters will go to both a day caucus and
the evening caucus—though AP says that fewer than 300 people are expected
at that later caucus. Concern about voter fraud in this instance seems
quite exaggerated. Really? A flood of fake Orthodox Jews to cast additional
votes?

fact, such 501(c)4 groups could end up being more prominent big-money
players than even super PACs. Crossroads GPS, for instance, accounted for $33
million of the Crossroads groups’ 2011 haul, while a pair of 501(c)4 groups
backing Democrats raised more than $1.7 million in the second half of the
year, with a pro-Obama 501(c)4 called Priorities USA transferring $215,000
of its haul to an affiliated super PAC called Priorities USA Action to cover
administrative expenses.”

_Crossroads Secret Money, and Less Democratic Secret Money_

Worth emphasizing from _this Politico report_
(http://www.politico.com/news/stories/0112/72272.html) : “The bulk of Crossroads’ 2011 haul – $33
million – went into a secret money group called Crossroads Grassroots Policy
Strategies (Crossroads GPS for short) that does not disclose its donors.”
And why _haven’t Dems _
(http://www.politico.com/news/stories/0112/72104.html) played the _anonymity game_
(http://www.politico.com/news/stories/0811/60731.html) as much? A few reasons:
1. There is a contested Republican primary, so there is a greater desire
for Republican money overall, to pick the eventual nominee. Dems are not yet
motivated to give as much, anonymous or not.
2. President Obama has a formidable fundraising machine, and there is less
need seen for outside groups (anonymous or not), at least at this stage of
the campaign.
3. President Obama has marketed himself as a reformer (whether he deserves
this label is much more contestable), who opposes super pacs and secret
money. So that makes fundraising for Democratic groups on this side harder.

_Thinking About Teaching a Law or Political Science Course on Election Law
During the Fall 2012 Semester? Read On_
(http://electionlawblog.org/?p=29009)
Posted on _February 1, 2012 9:33 am_ (http://electionlawblog.org/?p=29009)
 by _Rick Hasen_ (http://electionlawblog.org/?author=3)

[reposting from last month]
Teaching election law during the fall of a presidential election year is a
real treat (I remember teaching it during Florida 2000, which was
thrilling). I strongly recommend doing so.
If you are teaching the course, you should know of two books which will be
available in time for those with a fall class: (1) the Fifth Edition of
Election Law-Cases and Materials by Lowenstein, Hasen and Tokaji, and (2)
_The Voting Wars: From Florida 2000 to the Next Election Meltdown _
(http://electionlawblog.org/?p=22990) (forthcoming, Yale University Press).
Dan Tokaji and I are hard at work on the 5th edition of the _Election Law
casebook_ (http://www.cap-press.com/books/1800) . We are working to
streamline the book and make it more student-friendly, cutting back on some of the
notes and rearranging the material for ease of teaching. The book will be
up-to-date, including extensive coverage of Citizens United, super PACs,
and other campaign finance developments (the book would be suitable for a
seminar on campaign finance) as well as new developments in voting rights and
redistricting, including coverage of the Texas redistricting cases. There
will be expanded coverage of judicial elections. It will continue to
include perspectives from law and political science, and is appropriate in both
law and political science courses. For the first time, an electronic
version of the casebook will be available as well.
My book The Voting Wars will also be available. Several political
scientists are already assigning my draft manuscript this term. This is a book
written for a non-technical audience, which uses stories to tell of the
battles over election administration over the last dozen years, including issues
such as voter fraud, voter suppression, voter identification, voting
technology, and to explain how the rise of social media is changing the face of
election disputes. This book will be available for the Kindle and in other
electronic formats as well.
If you need advanced copies of either book, let me know and I will put you
in touch with the right publisher’s representative.
And now back to our regularly scheduled programming.
