[EL] New CA Redistricting lawsuit analysis

For those following the Court / referendum battle over California's State Senate redistricting:

 

The Rose Institute of State and Local Government at Claremont McKenna College released a new report <http://rosereport.org/home/entry/nesting-not-an-easy-option-for-california-supreme-court>  this morning. Given the conflict between the desire of the Court to defer to the legislative authority (in this case, the Redistricting Commission) and the desire of the voters who approved the provisions of Proposition 20 calling for the Court to intervene when a referendum is "likely" to qualify, the Court is holding a hearing tomorrow on what action it should take in light of the pending referendum. The new Rose Institute analysis looks at the appeal of nesting (the Court can intervene while still following the Commission's legislative decisions) and the potential Voting Rights Act problem of that option.
