"Measuring the Effects of Voter Identification Laws"
<http://electionlawblog.org/?p=36976>
Posted on July 16, 2012 8:36 am <http://electionlawblog.org/?p=36976> by

Absolute must-read
<http://fivethirtyeight.blogs.nytimes.com/2012/07/15/measuring-the-effects-of-voter-identification-laws/?hp>from
Nate Sliver on the effects of voter id laws. It is very consistent with
my conclusion in /The Voting Wars
<http://www.amazon.com/Voting-Wars-Florida-Election-Meltdown/dp/0300182031/ref=sr_1_cc_2?s=aps&ie=UTF8&qid=1329286945&sr=1-2-catcorr>/.
The likely effect of such laws is likely small (around 1% or so) in a
pro-Republican direction.
So Republicans are wrong to claim there is no partisan bias---and Dems
tend to exaggerate the likely effects.
Does that mean such laws are harmless? No.

Sunlight <http://sunlightfoundation.com/blog/2012/07/16/dark-money/>:
"As the Senate this week takes up the DISCLOSE Act, a bill that Sunlight
and other open government groups are supporting, it's worth enumerating
the reasons why. Let's start with $115 million. Call it a very
conservative estimate of the 2012 disclosure gap. Sunlight calculated it
by totaling what we know about just two of the most prominent 501(c)
groups with secret donors have spent ($127 million) and the spending
that /all/ such groups have actually reported to the Federal Election
Commission ($12 million)."

WaPo editorial
<http://www.washingtonpost.com/opinions/expose-the-fat-cats/2012/07/14/gJQA05KqkW_story.html>:
"AMERICANS WHO are worried about the corrosive power of big money in
politics ought to watch what is about to happen in the Senate. On
Monday, a cloture vote is scheduled on legislation that would require
the disclosure of donors anonymously pumping tens of millions of dollars
into this year's presidential and congressional campaigns. Not a single
Republican in the chamber has expressed support for the bill, known as
the Disclose Act, meaning it will probably die for this session. It
should be interesting to hear how the Republican senators justify this
monumental concealment of campaign cash."

"EXCLUSIVE: Florida Secretary of State Admits Identifying 'Potential
Non-citizens' using 'Obsolete" Data'"
<http://electionlawblog.org/?p=36953>
Posted on July 15, 2012 7:56 pm <http://electionlawblog.org/?p=36953> by

Dan Smith
<http://electionsmith.wordpress.com/2012/07/15/exclusive-florida-secretary-of-state-admits-identifying-potential-non-citizens-using-obsolete-data/>:
Of course, you wouldn't know that reading the completely misleading
headline in the 'AP NewsBreak
<http://www.washingtonpost.com/politics/ap-newsbreak-in-victory-for-gop-florida-wins-access-to-homeland-security-list-of-noncitizens/2012/07/14/gJQAHV16kW_story.html?hpid=z7>'
story rushed to publication by the /Washington Post/ and numerous
other outlets....
So, it is quite questionable how newly acquired access to the
federal SAVE database will help ferret out "potential noncitizens,"
as most citizens on the Florida voter rolls do not have a "unique
identifier" that is included in the federal database.
What is not questionable from the pending agreement is that the
Florida Secretary of State has admitted that it has been identifying
"potential noncitizens" using 'outdated' information.
As Secretary of State Ken Detzner stated in a Letter to Supervisors
Regarding SAVE
<http://electionsmith.files.wordpress.com/2012/07/7-14-2012-letter-to-supervisors-regarding-save1.pdf>
sent to the 67 Supervisors of Elections on Saturday, July 14:
The process to identify potential non-citizens will include a
carefully calibrated matching process between the Florida Voter
Registration System and the driver's license records of the Florida
Department of Highway Safety and Motor Vehicles before any records
are verified through SAVE. T*he existing file of potentially
ineligible voters which was created months ago, is now outdated and
will not be used as the basis for further action by the Department
of State. It should be considered obsolete*. (Emphasis in red, mine.)

last month, the Supreme Court issued a little-noticed decision in a
Maryland case that gave the green light to states to eliminate the
repugnant practice of 'prison-based gerrymandering.' States are now
unquestionably free to correct for an ancient flaw in the U.S. Census
that counts incarcerated people as residents not of their homes but of
the places where their prisons are located. When the prison population
was small, the problem was little more than statistical trivia. Today,
however, the census counts more than 2 million people as though they
were residents of places where they have no community ties."

David Schleicher has written this piece
<http://www.theatlantic.com/politics/archive/2012/07/all-politics-is-national/259789/>for
The Atlantic. A taste: "Elmendorf and I have come up with a few ideas.
Ballots could designate which party is in control of the state
legislature, allowing voters to more easily decide based on policies and
performance. States could mandate that ballots list candidates as, say,
'Massachusetts Republicans,' rather than just as 'Republicans,'allowing
voters to more easily disassociate the state and national parties. Voter
registration rules could be relaxed to allow separate membership in
parties for state and national elections. More radically, states could
ban national parties from contesting local elections
<http://ssrn.com/abstract=1122422>, allowing local parties to develop,
although this would face serious constitutional challenges."

AP
<http://www.nytimes.com/aponline/2012/07/14/us/politics/ap-us-florida-voter-list-purge.html?ref=politics>:
"In a victory for Republicans, the federal government has agreed to let
Florida use a law enforcement database to challenge people's right to
vote if they are suspected of not being U.S. citizens."
While this decision eliminates one aspect of the conflict over the
Florida voter purge, other lawsuits will no doubt continue, and the
battle over what county election officials do with the purge list
provided by the state remains unresolved.

<http://online.wsj.com/article/SB10001424052702304373804577525072239849392.html?mod=googlenews_wsj>:
"One of the judges, Rosemary Collyer, signaled her doubt about the Texas
expert's findings, saying they 'took enormous hits' during
cross-examination. Another judge, Robert Wilkins, questioned how it
could be fair to require people in certain remote parts of the state to
drive more than 100 miles to get a driver's license in order to vote,
while the rules of federal court say it is an undue burden to subpoena
someone to travel that far to appear in court."
