Since 1965, the Voting Rights Act has played a crucial role in congressional, state, and local redistricting. However, the role the VRA has played may be changing significantly as a result of recent events. In 2006, Congress reauthorized and amended portions of the VRA, making two changes at the heart of the Act that effectively overruled prior decisions of the United States Supreme Court. In 2009, the Supreme Court responded by expressing "serious misgivings" about the ongoing constitutionality of a portion of the Act (section 5) that requires certain jurisdictions to obtain preapproval for redistricting plans. Panelists will explore the postreauthorization status of the VRA, what it means for minority voting rights, how it could affect state and local government election activities and examine the basic federalism question of who manages the election process, the states or the federal.
