They are among the finest appellate lawyers I know and have the occasion
to work with.

They are the only firm of the 16 on the list without a Washington D.C.

    4th Circuit Affirms Right Under NVRA for Public Access to Completed
    Voter Registration Materials <http://electionlawblog.org/?p=35785>

Posted on June 18, 2012 8:21 am <http://electionlawblog.org/?p=35785> by
Rick Hasen <http://electionlawblog.org/?author=3>

Project Vote v. Long
<http://www.ca4.uscourts.gov/Opinions/Published/111809.P.pdf>: "The
question here is whether Section 8(i)(1) of the National Voter
Registration Act ("NVRA"), which requires public disclosure of "all
records concerning the implementation of programs and activities
conducted for the purpose of ensuring the accuracy and currency of
official lists of eligible voters," 42 U.S.C. § 1973gg-6(i)(1), applies
to completed voter registration applications. The district court
concluded that Section 8(i)(1) does apply to such applications and held
that defendants---Virginia election officials---had violated the NVRA by
refusing to disclose the completed applications with voters' Social
Security numbers redacted. Because the district court correctly
interpreted Section 8(i)(1), we now affirm the judgment."

It's not every day that a Project Vote victory gets praised

    Breaking (Non-)News: No Ruling in Montana Supreme Court Sequel
    <http://electionlawblog.org/?p=35776>

Posted on June 18, 2012 7:21 am <http://electionlawblog.org/?p=35776> by
Rick Hasen <http://electionlawblog.org/?author=3>

The Supreme Court has issued its orders and opinions today,
<http://howappealing.law.com/061812.html#046200> with no word on a
summary reversal or a cert. grant in the Montana case.

What does this mean? It /could/ mean that there is a summary reversal
coming, but the Court is waiting for one or more Justices to write
dissents or additional opinions as to the summary reversal. (I expect if
there is a reversal, at least Justice Ginsburg would write something
given her earlier unusual opinion with respect to the stay in the case.)

On the other hand, i recall that the Texas re-redistricting cases were
relisted 5 times on the Court's conference list before the Court
ultimately agreed to hear the case rather than issue a summary disposition.

So we /could /hear something by the end of the term's argument days
(likely next Thursday), or something could come right before the first
Monday in October (or even later)

    "McConnell Accuses Obama and Aides of Schemes to Curtail Free

Posted on June 17, 2012 9:56 pm <http://electionlawblog.org/?p=35772> by

NYT's "The Caucus:"
<http://thecaucus.blogs.nytimes.com/2012/06/15/mcconnell-accuses-obama-and-aides-of-schemes-to-curtail-free-speech/>"Senator
Mitch McConnell
<http://topics.nytimes.com/top/reference/timestopics/people/m/mitch_mcconnell/index.html?inline=nyt-per>
of Kentucky on Friday accused President Obama
<http://topics.nytimes.com/top/reference/timestopics/people/o/barack_obama/index.html?inline=nyt-per>,
his campaign and his administration of engaging in Nixonian dirty
tricks, including keeping an enemies list, inciting "mob" attacks on its
critics and leaking confidential tax information, in a concerted effort
to curtail the free speech of his opponents. The same week that the
casino magnate Sheldon Adelson
<http://topics.nytimes.com/top/reference/timestopics/people/a/sheldon_g_adelson/index.html?inline=nyt-per>
contributed $10 million to an anti-Obama 'super PAC
<http://topics.nytimes.com/top/reference/timestopics/subjects/c/campaign_finance/index.html?inline=nyt-classifier>,'
Mr. McConnell went to the conservative American Enterprise Institute
<http://topics.nytimes.com/top/reference/timestopics/organizations/a/american_enterprise_institute_for_public_policy_research/index.html?inline=nyt-org>
to defend what he called the right of free speech. He also delivered a
broadside against a president he said is 'attempting to change the First
Amendment.'"

This is just more of the Right trying to "elide the distinction
<http://www.politico.com/news/stories/0512/76919.html> between holding
people and organizations accountable for the actions they take and the
concept of harassment and intimidation."

    Larry Lessig Calls for Amending the Constitution to Provide for
    Campaign Finance Vouchers <http://electionlawblog.org/?p=35763>

Posted on June 17, 2012 9:21 pm <http://electionlawblog.org/?p=35763> by
Rick Hasen <http://electionlawblog.org/?author=3>

Larry Lessig's contribution
<http://hive.slate.com/hive/how-can-we-fix-constitution/article/upon-the-people-alone>
to Slate's "Hive," How to Fix the Constitution.
<http://hive.slate.com/hive/how-can-we-fix-constitution>

The amendment builds on the ideas on Larry's book, "Republic, Lost,"
which I am reviewing (along with a review of Jack Abramoff's new book,
Capitol Punishment") for the /Harvard Law Review/. (Draft of my review
<http://papers.ssrn.com/sol3/papers.cfm?abstract_id=2017026>is here.)

Lessig's book called for campaign finance vouchers (an idea I have
supported sincewriting about them in 1996
<http://papers.ssrn.com/sol3/papers.cfm?abstract_id=1961263>).  In his
book, vouchers would supplement, not supplant, private giving. I the
Slate iteration, individuals are limited to $100 contributions to
candidates. But Larry also wants to incorporate Larry Tribe's proposed
amendment
<http://hive.slate.com/hive/how-can-we-fix-constitution/article/the-once-and-for-all-solution-to-our-campaign-finance-problems>
to the Constitution, which would presumably allow limiting contributions
to Super PACs too.

Important Dave Levinthal report for Politico
<http://www.politico.com/news/stories/0612/77451.html>: "Barack Obama
has long cast himself as a warrior against the influence of big money in
politics. But as the 2012 election is saturated by billions of dollars,
campaign-finance reformers have largely lost faith in a president they
say is willfully neglecting his reformist agenda while cynically
embracing key elements of a new, laissez-faire election system he's long

Bloomberg

"The U.S. Chamber of Commerce's advertising is outpacing both political

which have been questioned by fact-checkers --- being aired against
Democrats. The nation's biggest business lobby is second only to
Crossroads Grassroots Policy Strategies, a Republican group supporting

There are a lot of things one can say about Sheldon Adelson's Super PAC
money, but to call it
<http://thecable.foreignpolicy.com/posts/2012/06/15/mccain_adelson_funding_romney_super_pac_with_foreign_money>"foreign
money" because he and his companies make profits overseas does not seem

    "Aetna Confirms It Gave $7.8 Million To Chamber, American Action
    Network" <http://electionlawblog.org/?p=35744>

Tip of a very large iceberg, I suspect.

Must-read
<http://news.bna.com/mpdm/MPDMWB/split_display.adp?fedfid=27071457&vname=mpebulallissues&jd=a0d3d5m7n5&split=0>
Bloomberg BNA: "The insurance company Aetna confirmed June 14 that it
donated about $7.8 million to two major Republican-leaning
organizations---the U.S. Chamber of Commerce and American Action
Network---which have sponsored tens of millions of dollars worth of
political ads but have never disclosed their funding sources. The
revelation---which came due to an accidental filing by Aetna---was
significant because few, if any, political donations from large, public
corporations have been revealed previously....'We support organizations
and candidates who share our views on how to fix the problems facing our
health care system, as well as our country,' [Aetna President] Bertolini
said. 'We fully comply with all federal and state disclosure
requirements.'...The Chamber spent over $30 million on television ads in
the 2010 congressional elections---nearly all of it backing Republican
candidates or attacking Democrats."

    "WyLiberty Attorneys File Lawsuit to Stop FEC Chill on Free Speech"

Press release
<http://wyliberty.org/feature/wyliberty-attorneys-file-lawsuit-to-stop-fec-chill-on-free-speech/>:
"Wyoming Liberty Group attorneys filed a lawsuit
<http://wyliberty.org/wp-content/uploads/2012/06/Free-Speech-v-FEC-Verified-Complaint.pdf>
in the Wyoming federal district court today against the Federal Election
Commission (FEC) on behalf of Free Speech, a Wyoming grassroots
organization...The suit, Free Speech v. Federal Election Commission,
argues that vague and overbroad FEC regulations, which require
grassroots groups to register as 'political committees' (PACs),
effectively shut down much speech in the heartland."

It is not clear how much this complaint overlaps with the recent 4th
Circuit decision <http://electionlawblog.org/?p=35602> in the /Real
Truth About Obama/ case.

    "End the Voting Wars: Take our elections out of the hands of the
    partisan and the incompetent." <http://electionlawblog.org/?p=35724>

Posted on June 14, 2012 8:28 am <http://electionlawblog.org/?p=35724> by
Rick Hasen <http://electionlawblog.org/?author=3>

I have written this piece
<http://hive.slate.com/hive/how-can-we-fix-constitution/article/end-the-voting-wars>
for /Slate/, part of its ts "How to Fix the Constitution" Hive
<http://www.slate.com/articles/life/the_hive.html>. It begins:

    My field is election law, and in this area it's really easy to come
    up with a sexy but risky fix that might improve the U.S.
    Constitution: Abolish <http://www.nationalpopularvote.com/> the
    Electoral College. Overturn <http://movetoamend.org/> /Citizens
    United/ and the flood of corporate money in elections
    <http://hive.slate.com/hive/how-can-we-fix-constitution/article/the-once-and-for-all-solution-to-our-campaign-finance-problems>.
    Establish <http://ni4d.us/> a national initiative allowing voters to
    vote directly on legislation instead of going through Congress,
    making the United States more like California. I have a change that
    will sound less sexy but is more needed than all of them: Create an
    independent, nonpartisan agency to run our federal elections.

    The United States is one of the few mature democracies that leaves
    the rules for counting elections in local hands, and, in a majority
    of states, that means partisan officials are in charge. Think about
    it: We have people running our elections whose ultimate allegiance
    is not to the integrity of the vote count but to the Republican
    Party or the Democratic Party.

    So when Florida's Republican Gov. Rick Scott defends
    <http://www.theledger.com/article/20120606/POLITICS/120609606/1004/news?p=1&tc=pghttp://www.theledger.com/article/20120606/POLITICS/120609606/1004/news?p=1&tc=pg>
    his latest purge of voters as necessary to keep illegal voters from
    voting, why should we believe <http://electionlawblog.org/?p=35134>
    he is doing this in the best interest of the integrity of the
    elections rather than to give Romney and edge over Obama in the
    perennial swing state? And when Obama's Justice Department objects
    to the purge, why should we believe
    <http://www.nationalreview.com/articles/301900/who-may-vote-florida-hans-von-spakovsky>
    it is acting to preserve voter access to the polls rather than
    trying to give that edge
    <http://www.nytimes.com/2012/06/07/us/florida-vows-to-continue-its-search-for-ineligible-voters.html?ref=politicshttp://www.nytimes.com/2012/06/07/us/florida-vows-to-continue-its-search-for-ineligible-voters.html?ref=politics>
    to Obama?

    As I document <http://thevotingwars.com> in my upcoming book, /The
    Voting Wars: From Florida 2000 to the Next Election Meltdown
    <http://www.amazon.com/gp/product/0300182031/ref=as_li_ss_tl?ie=UTF8&tag=slatmaga-20&linkCode=as2&camp=1789&creative=390957&creativeASIN=0300182031>/,
    the fights over election rules, especially over controversial new
    voter identification rules, have gotten much worse since /Bush v.
    Gore/ in 2000....
