Registration Act ("NVRA"), which requires public disclosure of "all
records concerning the implementation of programs and activities
conducted for the purpose of ensuring the accuracy and currency of
official lists of eligible voters," 42 U.S.C. § 1973gg-6(i)(1), applies
to completed voter registration applications. The district court
concluded that Section 8(i)(1) does apply to such applications and held
that defendants---Virginia election officials---had violated the NVRA by
refusing to disclose the completed applications with voters' Social
Security numbers redacted. Because the district court correctly
interpreted Section 8(i)(1), we now affirm the judgment."

Breaking (Non-)News: No Ruling in Montana Supreme Court Sequel

The Supreme Court has issued its orders and opinions today,
<http://howappealing.law.com/061812.html#046200> with no word on a
summary reversal or a cert. grant in the Montana case.
What does this mean? It /could/ mean that there is a summary reversal
coming, but the Court is waiting for one or more Justices to write
dissents or additional opinions as to the summary reversal. (I expect if
there is a reversal, at least Justice Ginsburg would write something
given her earlier unusual opinion with respect to the stay in the case.)
On the other hand, i recall that the Texas re-redistricting cases were
relisted 5 times on the Court's conference list before the Court
ultimately agreed to hear the case rather than issue a summary disposition.
So we /could /hear something by the end of the term's argument days
(likely next Thursday), or something could come right before the first
Monday in October (or even later)

The amendment builds on the ideas on Larry's book, "Republic, Lost,"
which I am reviewing (along with a review of Jack Abramoff's new book,
Capitol Punishment") for the /Harvard Law Review/. (Draft of my review

Lessig's book called for campaign finance vouchers (an idea I have
supported sincewriting about them in 1996

book, vouchers would supplement, not supplant, private giving. I the
Slate iteration, individuals are limited to $100 contributions to
candidates. But Larry also wants to incorporate Larry Tribe's proposed
amendment

donated about $7.8 million to two major Republican-leaning
organizations---the U.S. Chamber of Commerce and American Action
Network---which have sponsored tens of millions of dollars worth of
political ads but have never disclosed their funding sources. The
revelation---which came due to an accidental filing by Aetna---was
significant because few, if any, political donations from large, public
corporations have been revealed previously....'We support organizations
and candidates who share our views on how to fix the problems facing our
health care system, as well as our country,' [Aetna President] Bertolini
said. 'We fully comply with all federal and state disclosure
requirements.'...The Chamber spent over $30 million on television ads in

in the Wyoming federal district court today against the Federal Election
Commission (FEC) on behalf of Free Speech, a Wyoming grassroots
organization...The suit, Free Speech v. Federal Election Commission,
argues that vague and overbroad FEC regulations, which require
grassroots groups to register as 'political committees' (PACs),
effectively shut down much speech in the heartland."
It is not clear how much this complaint overlaps with the recent 4th

My field is election law, and in this area it's really easy to come
up with a sexy but risky fix that might improve the U.S.
Constitution: Abolish <http://www.nationalpopularvote.com/> the
Electoral College. Overturn <http://movetoamend.org/> /Citizens
United/ and the flood of corporate money in elections

Establish <http://ni4d.us/> a national initiative allowing voters to
vote directly on legislation instead of going through Congress,
making the United States more like California. I have a change that
will sound less sexy but is more needed than all of them: Create an
independent, nonpartisan agency to run our federal elections.
The United States is one of the few mature democracies that leaves
the rules for counting elections in local hands, and, in a majority
of states, that means partisan officials are in charge. Think about
it: We have people running our elections whose ultimate allegiance
is not to the integrity of the vote count but to the Republican
Party or the Democratic Party.
So when Florida's Republican Gov. Rick Scott defends
