Those goals are not mutually exclusive.  Reasonable people (and
unreasonable people such as myself) disagree about how best to serve those
goals, which is why we have elections in the first place.  Of course, many
states and the US gov't do not have judicial elections because of the
special nature of the judicial function.  Compare the notion of apponting
a legislature (or the President).
