Two New Brennan Center Reports <http://electionlawblog.org/?p=42630>
Posted on October 28, 2012 10:34 pm
<http://electionlawblog.org/?p=42630> by Rick Hasen
<http://electionlawblog.org/?author=3>
Via email, the Brennan Center was slated to release two election-related
reports this week but has released them now due to Hurricane Sandy:
1. /*Voting Law Changes: Election Update
<http://www.brennancenter.org/page/m/64f5890c/28892d4a/33a7f16d/6d46e323/666545968/VEsE/>*:/ New
laws making it harder to cast a ballot in 2012 will affect far fewer
than the 5 million citizens we predicted last year
<http://www.brennancenter.org/page/m/64f5890c/28892d4a/33a7f16d/6d46e322/666545968/VEsF/>,
our new report finds. Overall, laws in 14 states were reversed,
blunted, repealed, or weakened.
"For the overwhelming majority of those whose rights were most at
risk, the ability to vote will not be at issue on November 6th,"
*the report reads
<http://www.brennancenter.org/page/m/64f5890c/28892d4a/33a7f16d/6d46e323/666545968/VEsC/>*.
The study also details the fights still to come after November ---
in state courts, in statehouses, and in the U.S. Supreme Court....
2. *Recount Rules*: Will we even know who won on election night?
With an increasingly tight presidential race, it's clear the
election could come down to just a few thousand votes in key states.
Reports already indicate a nightmare scenario in Ohio
<http://www.brennancenter.org/page/m/64f5890c/28892d4a/33a7f16d/6d46e321/666545968/VEsD/>,
with a new law stating provisional ballots may not be counted until
at least Nov. 17. Similar requirements in other states may be an
issue on or after Election Day as well. ...

"Documents Found in Meth House Bare Inner Workings of Dark Money

ProPublica/Frontline
<http://www.propublica.org/article/documents-found-in-meth-house-bare-inner-workings-of-dark-money-group?utm_medium=twitter&utm_source=twitterfeed>:
The boxes landed in the office of Montana investigators in March 2011.
Found in a meth house in Colorado, they were somewhat of a mystery,
holding files on 23 conservative candidates in state races in
Montana. They were filled with candidate surveys and mailers that
said they were paid for by campaigns, and fliers and bank records
from outside spending groups. One folder was labeled "Montana $ Bomb."
The documents pointed to one outside group pulling the candidates'
strings: a social welfare nonprofit called Western Tradition
Partnership, or WTP.
Altogether, the records added up to possible illegal "coordination"
between the nonprofit and candidates for office in 2008 and 2010,
said a Montana investigator and a former Federal Election Commission
chairman who reviewed the material. Outside groups are allowed to
spend money on political campaigns, but not to coordinate with
candidates
