"After more than a decade working side by side, the two men rarely talk
these days. But Senate Minority Leader Mitch McConnell and Steven Law,
his trusted former aide, remain a powerful combined force in
Washington. Law heads American Crossroads and Crossroads GPS,
conservative groups whose $300 million budget has allowed them to
outspend every other interest group in this election, as well as the
Democratic National Committee. Together, the two groups have matched the
Romney campaign in running anti-Obama ads,
<http://www.washingtonpost.com/wp-srv/special/politics/track-presidential-campaign-ads-2012/> and
in the past two months, they have put $35 million into 10 Senate races
around the country --- more than the Republican Party itself."

Republican attorney who engineered the 2000 Florida felons list, which
African American leaders said purged thousands of eligible blacks from
voter rolls in the state and helped swing that election to the GOP, also
wrote the first draft of Florida's controversial House Bill 1355 that
has restricted early voting and voter registration campaigns in 2012."

Howard Wasserman
<http://www.concurringopinions.com/archives/2012/10/politics-partisanship-and-democracy.html>:
"Thus, inability to carry out an election is no small thing and should
not be treated, or discussed, as such. It would be no mere minor
inconvenience if New Jersey or New York are unable to administer
elections next month--or unable to efficiently administer elections in
which those who want to vote are able to do so. It would be a genuine
problem about the functioning of a supposedly democratic national
government. Alternatively, if we really believe that we must "come
together" and put all electoral conflicts aside and not concern
ourselves with an ongoing election, then Hasen is right that we must
establish mechanisms to postpone the whole thing or otherwise alter the
rules. We should not ignore the problems or let the election go forward
as planned and simply accept sub-optimal processes in those places still
recovering from the storm."

Here's a question about Charles Munger Jr. that's been buried by

anti-union initiative and torpedo Gov. Jerry Brown
<http://www.latimes.com/topic/politics/government/jerry-brown-PEPLT007547.topic>'s
tax initiative in next week's election: Has he been maneuvering to
bankrupt a public interest activist who had the temerity to mount a

That's the picture of the multimillionaire being painted by the
activist, Richard Winger, 69, who has run San Francisco-based Ballot

Winger's efforts to track voter-rights litigation nationwide operate

Keene Star <http://www.keenestar.net/ci_21888280>: "A Keene resident who
owns a restaurant in Cleburne and is a candidate to be Keene's highest
ranking elected official is in a pickle. Dan Roberts, one of three
candidates to be mayor of Keene, is being investigated by the Texas
Rangers because of a campaign business card that also offers a discount
to his restaurant. On one side of the card is language soliciting a vote
for Roberts. On the reverse side is a coupon good for 10 percent off any

Press Release: Secretary of State Connie Lawson warns Hoosiers to
disregard letters claiming to be a "voting record audit"

*Secretary of State Connie Lawson warns Hoosiers to disregard letters
claiming to be a "voting record audit"*
/Letters claim to list individual voting records/**
**
*INDIANAPOLIS**(October 30, 2012)*--Secretary of State Connie Lawson has
received numerous complaints from Hoosier voters who received letters
from Americans for Limited Government. These letters purport to be
neighborhood voting record audits. The letter lists an individual's
name, address and voter participation for 2008, 2010 and 2012. It also
lists neighbors of the individual and their voter participation history.
"The State of Indiana does not treat lightly its role to strictly limit
access to voting records and we are not aware of any improper use of the
State's resources to conduct such an 'audit'," said Secretary of State
Connie Lawson. "Many of the Hoosiers who have contacted our office have
indicated that their voting records as stated in the letter were
inaccurate. I would advise anyone who receives the letter to disregard it."
Indianalaw restricts the availability of voter participation records.
The state only provides this information to state political parties and
legislative caucuses; however voter participation records can be
accessed from county voter registration offices.

"Super PACs, nonprofits favored Romney over Obama"

Super PACs and nonprofits unleashed by the /Citizens United
<http://www.publicintegrity.org/2012/01/03/7782/big-bucks-flood-2012-election-what-courts-said-and-why-we-should-care/>/ Supreme
Court decision have spent more than $840 million
<http://www.opensecrets.org/outsidespending/summ.php?cycle=2012&chrt=V&disp=O&type=P> on
the 2012 election, with the overwhelming majority favoring
Republicans, particularly GOP presidential nominee Mitt Romney
<http://www.opensecrets.org/pres12/candidate.php?id=N00000286>.
An estimated $577 million, or roughly 69 percent, was spent by
conservative groups, compared with $237 million spent by liberal
groups, or about 28 percent, with the remainder expended by other
organizations.
Of all outside spending in the 2012 election, more than $450 million
was dedicated to the presidential election with more than $350
million spent helping Romney and about $100 million spent to help
President Barack Obama.
The spending helped close the gap on Obama's considerable
fundraising advantage over Romney. As Election Day approaches,
Romney and Obama are neck-and-neck in national polls.
The totals are from a joint analysis of Federal Election Commission
data by theCenter for Responsive Politics
<http://www.opensecrets.org/> and the Center for Public Integrity
<http://www.publicintegrity.org/>. The Centers' analysis covers the
period from Jan. 1, 2011 through Oct. 28, 2012, and does not include
independent spending by the political party committees.

"How Many More Near-Election Disasters Before Congress Wakes Up?"
<http://electionlawblog.org/?p=42781>
Posted on October 30, 2012 3:20 pm <http://electionlawblog.org/?p=42781>

I have written this piece
<http://www.thedailybeast.com/articles/2012/10/30/how-many-more-near-election-disasters-before-congress-wakes-up.html>
for /The Daily Beast. /It begins:
The destruction wrought by superstorm Sandy has been horrific
enough, but if there's anything to be grateful for, it's the storm's
timing. If Sandy had hit just one week later, we'd be facing a
constitutional crisis
<http://www.theatlantic.com/politics/archive/2012/10/could-a-hurricane-like-sandy-postpone-the-presidential-election/264254/>. As
it is, there is plenty
<http://blog.lib.umn.edu/cspg/electionacademy/2012/10/hurricane_sandy_prompts_renewe.php> of
speculation
<http://www.theatlantic.com/politics/archive/2012/10/could-a-hurricane-like-sandy-postpone-the-presidential-election/264254/> on
the possible effects of the storm
<http://www.tnr.com/blog/plank/109364/how-hurricane-sandy-could-spoil-election-day#> on
the Nov. 6 election
<http://www.buzzfeed.com/chrisgeidner/hurricanes-late-october-landfall-raises-election>.
There are multiple and conflicting answers to the concerns being
raised---from political to statutory to constitutional---but they
all obscure a larger and more troubling truth: There is absolutely
no reason for us to be in this situation in the first place.
It concludes:
Worst of all for disaster planning, legislatures are passing
election reforms on party-line votes. With the exception of Rhode
Island, the tough new voter-ID laws have been favored almost
exclusively by Republicans and opposed almost exclusively by
Democrats. Election Day Registration, which recently passed in
California, is supported by Democrats and opposed by Republicans. In
short, there has been no bipartisan space for election reform in the
state, and there's no reason to think Congress would do any better.
But bipartisanship is exactly what is needed now
<http://moritzlaw.osu.edu/electionlaw/comments/index.php?ID=9969>,
just like it is needed to deal with contingency plans if the House
of Representatives were hit by a terrorist attack
<http://www.washingtonpost.com/wp-dyn/content/article/2007/07/11/AR2007071102079.html> (another
issue Congress has irresponsibly ignored aside from holding hearings
<http://www.gpo.gov/fdsys/pkg/CHRG-108shrg96926/html/CHRG-108shrg96926.htm>).
Some things are just too big for partisan bickering.
At the end of my book /The Voting Wars/
<http://www.amazon.com/dp/0300182031/ref=as_at?tag=thedailybeast-autotag-20&linkCode=as2&>,
I point out how Japan's reaction to the devastating 2011
tsunami---raising its sea walls---was simply what humans often do:
responding to the last disaster. But Congress hasn't even done that
much. When it comes to planning for catastrophes near election time,
we've had at least two major disasters in the past decade, not to
mention the Florida debacle---and through it all Congress has sat on
its hands. Will it keep sitting until it's too late?
