In my post, I focused on IJ's representation of Recall Dale Washam, which
is a section 1983 claim. This should, at a minimum--as IJ argued in its
emergency injunction motion--be distinguished from in-kind legal services
performed for campaign compliance, etc. At a maximum, courts should
recognize any system that requires legal/accounting services to participate
in the political process is unconstitutional, but I digress.
I don't believe it complicates anything that plaintiffs seek attorneys'
fees in pro bono litigation. What complicates things is when agencies twist
this into a new reason to harass political speakers. Thanks for the link;
