    Last Possible Chance for McCutcheon Opinion in 2013 Coming Monday

The fact that an opinion in /McCutcheon/ has not come yet means it is 
not likely there was a majority to take Justice Breyer's suggestion at 
oral argument to punt in the case and send it back to the trial court 
for factfinding.

It could still happen---look how long last term the Supreme Court held 
the /Fisher/ affirmative action case before punting. But if a punt 
happens so late, it probably means it was not the original plan but 
something happened during the opinion drafting process.

    Parties who are a gulf apart over what laws should be in place to
    ensure fair and open elections are just as widely divided about how
    quickly a lawsuit challenging new voter laws should be heard in
    federal court....

    he U.S. Department of Justice filed a lawsuit against North Carolina
    in October arguing that four key provisions of the state's sweeping
    election law changes should be blocked on grounds that they would
    have a discriminatory effect on African-American voters.

    The Justice Department, however, agrees with attorneys for the state
    on the scheduling conflict. The federal officials do not believe,
    according to the lawsuit, that all the information pertinent to the
    legal challenge can be exchanged in time to air the case in court
    before the 2014 elections.

    That leaves another option, though.

    Attorneys for the voters and civil rights organizations arguing
    against the election law changes could seek preliminary relief from
    the courts that halts the changes from going into effect while the
    lawsuit pends.

    Ohio would cross-reference voter addresses with other state
    databases to try to clean up discrepancies under a voting bill
    that's likely to pass the General Assembly on Wednesday.The
    legislation is part of a collection of Republican-sponsored bills
    that Democrats and civil rights activists say are slowly chipping
    away at voting rights in Ohio, the quintessential swing state. Most
    of the other bills won't get a vote until next year, and many may
    not get a vote at all.

    A handful of Republican Party officials is quietly advancing a new
    batch of rules aimed at streamlining a chaotic presidential
    nominating process that many party insiders viewed as damaging to
    the their campaign for the White House in 2012, multiple GOP sources
    told CNN.

    In a series of closed-door meetings since August, handpicked members
    of the Republican National Committee have been meeting with party
    Chairman Reince Priebus in Washington to hash out details of a
    sweeping plan to condense the nominating calendar, severely punish
    primary and caucus states that upend the agreed-upon voting order
    and potentially move the party's national convention to earlier in
    the summer, with late June emerging as the ideal target date.
