On Saturday the Election Law Blog will be down for maintenance.
Blogging will be light through New Years--regular ELB News and
Commentary mailings for Election Law listserv members will resume on
January 6.
Once again it has been a busy year for the Election Law Blog and 2014
promises some big news in the area of voting rights, campaign finance,
filibuster reform/political polarization and other topics. More posts
from ELB regular commentators are on tap as well.
I wish all my readers a safe, healthy and happy 2014.

The non-ideological, non-partisan enforcement of law is fundamental
to the public's trust in the Department. Yet in a recent report
assessing how the enforcement priorities of the Voting Section of
the Civil Rights Division have changed over time and whether the
voting rights laws have been enforced in a non-discriminatory
fashion, the OIG identified issues in the handling of a small number
of cases that the OIG believed risked undermining public confidence
in the non-ideological enforcement of the voting rights laws. The
investigation also revealed several incidents in which deep
ideological polarization fueled disputes and mistrust that harmed
the functioning of the Voting Section, including numerous examples
of harassment and marginalization of employees and managers due, at
least in part, to their perceived ideological or political beliefs.
These incidents received substantial public attention through
congressional hearings and media reporting, thereby feeding the
concern that the administration of justice had become politicized.
The OIG will monitor the Department's corrective actions taken in
response to our report.
This is the sole mention of the Voting Section in the Dec. 11 report

Overseas Vote Foundation (OVF), a nonpartisan, nonprofit
organization dedicated to overseas, military, and domestic absentee
voter participation has received a grant from the Democracy Fund in
support of a research-based approach to the unanswered question of
whether remote absentee voting can be conducted securely online.
The project is called /End-to-End Verifiable Internet Voting:
Specification and Feasibility Assessment Study (E2E VIV Project)/
and will examine a form of remote voting that enables a so-called
"end-to-end verifiability" (E2E) property. A unique team of experts
in computer science, usability, and auditing together with a
selection of local election officials from key counties around the
U.S. will assemble for this study.

really, *REALLY* important development; while states that have already
adopted OVR often cite eligibility checks as a benefit, that fact often
gets lots alongside expanding the electorate and cost efficiency. As the
country prepares to enter another federal election year -- which will
inevitably bring renewed focus on the incidence and impact of voter
fraud, including non-citizen voting -- support for OVR as an anti-fraud
measure could become a new talking point across the country. Given that
OVR tends to attract consensus more than voter ID, this could signal
another wave of states joining the trend toward online registration."
