I am not able to attend oral arguments today in /Shelby County/, and
thanks to the Supreme Court's indefensible rules, there is no live
streaming audio or video of the argument. A transcript will be released
later today, which I will read, link to, and comment upon. Audio will
be released on Friday afternoon. I will also link to news reports from
oral argument, as they become available, likely beginning an hour or so
from now.
In the meantime, Howard had twofinal
<http://howappealing.law.com/022713.html#049643> roundups
<http://howappealing.law.com/022613.html#049639>of VRA stories and
commentaries. I've written three opeds in advance of the argument:
What's Lost if the Voting Rights Falls?
<http://www.slate.com/articles/news_and_politics/jurisprudence/2013/01/voting_rights_act_what_s_lost_if_the_supreme_court_kills_it.html>
(/Slate/)
If the Court Strikes Section 5 of the Voting Rights Act

(Reuters)
Who Controls Voting Rights?
<http://blogs.reuters.com/great-debate/2013/02/26/who-controls-voting-rights/>
(Reuters)
I organized this symposium
<http://www.reuters.com/subjects/voting-rights>at Reuters. SCOTUSBlog
<http://www.scotusblog.com/category/special-features/the-court-and-the-voting-rights-act/>
also ran an excellent symposium. ACS has this Shelby County resource
page <http://www.acslaw.org/voting-rights>.
And for those who wish to go back in time: My first writing on the
issues being argued today was in 2005, in writing edited by Chris
Geidner: Congressional Power to Renew the Preclearance Provisions of the
Voting Rights Act after Tennessee v. Lane
<http://papers.ssrn.com/sol3/papers.cfm?abstract_id=561241>. My 2006
testimony before the Senate Judiciary Committee on the serious
constitutional questions with renewing the act without making any
changes is here
<http://www.judiciary.senate.gov/hearings/testimony.cfm?id=e655f9e2809e5476862f735da1137d6e&wit_id=e655f9e2809e5476862f735da1137d6e-1-3>.
My article analyzing what was likely to happen after the Supreme Court
raised constitutional questions in the NAMDNO case appeared in the 2010
/Supreme Court Review/ (contrasting NAMUDNO with /Citizens United/) in
Constitutional Avoidance and Anti-Avoidance by the Roberts Court.
<http://papers.ssrn.com/sol3/papers.cfm?abstract_id=1436669>
Whatever else one can say if the Supreme Court strikes section 5, one
cannot say it was unexpected.

"Miller blasts Obama's plan for election standards"

Daily Tribune:
<http://www.dailytribune.com/article/20130226/NEWS01/130229602/miller-blasts-obama-s-plan-for-election-standards>
U.S. Rep. Candice Miller, relying upon her experiences as Michigan
secretary of state, is denouncing President Obama's plan to form a
national election commission which will seek solutions to long waits
for voters on Election Day.
"That's about the last thing we need is another election
commission," Miller said, asserting that reforms should be left to
the states that had voting problems last fall.
This is one of the reasons I suggested
<http://electionlawblog.org/?p=47191> that the goals of Bauer-Ginsberg
are quite modest. Federal legislation won't get out of the House
Administration Committee, which Rep. Miller chairs.

<http://news.bna.com/mpdm/MPDMWB/split_display.adp?fedfid=29847696&vname=mpebulallissues&jd=a0d6r9e0y1&split=0>:
Two Virginia businessmen, William Danielczyk and Eugene Biagi,
pleaded guilty Feb. 26 to charges of violating campaign finance laws
by funneling nearly $200,000 in corporate contributions to campaign
committees of Hillary Clinton, the former senator from New York and
secretary of state (U.S. v. Danielczyk, E.D. Va., Criminal No.
11-85, pleas entered 2/26/13).
Plea agreements signed in the case indicated that Danielczyk could
face five years in prison as a result of the long-running criminal
case, while Biagi faces probable probation and a fine. They are due
to be sentenced May 17.
Danielczyk and Biagi agreed to plead guilty in an unexpected move on
the day a trial was set to begin in their case in federal court in
Alexandria, Va. The development came a day after the Supreme Court
said it would not take up a challenge to the century-old federal ban
on corporate campaign contributions, which stemmed from a pre-trial
ruling in the case (U.S. v. Danielczyk, U.S. No. 12-579, cert.
denied 2/25/13; 3456 Money & Politics Report, 2/26/13
