"Republican IRS agent says Cincinnati began 'Tea Party' inquiries"

<http://www.chicagotribune.com/news/politics/sns-rt-us-usa-irs-scrutinybre9580a8-20130609,0,5537098.story>:
A U.S. Internal Revenue Service manager, who described himself as a
conservative Republican, told congressional investigators that he
and a local colleague decided to give conservative groups the extra
scrutiny that has prompted weeks of political controversy.
In an official interview transcript released on Sunday by Democratic
Representative Elijah Cummings, the manager said he and an underling
set aside "Tea Party" and "patriot" groups that had applied for
tax-exempt status because the organizations appeared to pose a new
precedent that could affect future IRS filings.
If this pans out this could be an important development.

"Lying in Campaigns---and the Functions of Super PACs"

Bob Bauer
<http://www.moresoftmoneyhardlaw.com/2013/06/lying-campaigns-super-pacs/>:
Rick Hasen recently published an interesting article
<http://papers.ssrn.com/sol3/papers.cfm?abstract_id=2151618>on the
legal remedies for malicious lying in politics. Richard L. Hasen, /A
Constitutional Right to Lie in Campaigns and Elections/, 74 Mont. L.
Rev. 53 (Winter 2013) . He fears that "false and misleading speech
may be increasing" in a "highly charged partisan atmosphere, in
which each side cannot agree upon the basic facts," and that the
media, including the burgeoning fact-checking corps, "are not able
to meaningfully curb candidates' lies and distortions." /Id/. at 54.
55. Legal responses seem largely beyond reach, particularly after
the Supreme Court's decision in /Alvarez v. United States/, 132 S.
Ct. 2537 (2012), which Hasen reads to indicate that "broad laws
targeting false speech stand little chance of being upheld,
regardless of topic." /Id/. at 69.
Among several issues of note, one stands out as illustrating the
complications besetting the current federal campaign finance
structure. If there is more lying in politics, we might expect this
to correlate with an increase in the number and activities of Super
PACs. The link that comes most immediately to mind is the connection
many draw between Super PAC advertising and hyperbolic campaign
advertising. This may not be the only connection or even the key
one. Federal candidates contending with proliferating false speech
may also need Super PACs for their /defense/, for want under the
regulatory regime of an alternative source of funds to deflect or
manage maliciously false charges.

President Obama Renominates Hicks and Perez to Seats on EAC, But...

See here
<http://www.whitehouse.gov/the-press-office/2013/06/07/presidential-nominations-sent-senate-0>.
Don't hold your breath on either these two nominees getting a hearing
any time soon or Republicans putting forward two nominees of their own
for the zombie commission. From my conversations with some influential
Republicans, it sounds like the view is that the EAC is a failed
experiment and nothing should be done to revive it.
The House voted again this week toget rid
<http://electionlawblog.org/?p=51270> of the agency. No reason to expect
Democrats in the Senate to go along with that, but no reason to think
anything will happen in the short term to revive the agency either.

"Future of voting rights up in the air: In Plain English"

Amy Howe:
<http://www.scotusblog.com/2013/06/future-of-voting-rights-up-in-the-air-in-plain-english/#more-164579>
We often think of Justice Anthony Kennedy as the swing vote on the
Court, and that might eventually wind up being the case here. But
nothing that he said at the oral argument gave supporters of the
Voting Rights Act much hope that he would vote to uphold the law in
its current form. And Court watchers are now predicting that Chief
Justice John Roberts will be the author of the Court's opinion in
the case, which can only make the law's supporters more nervous.
Will the Chief Justice surprise us all by pulling a "health care"
here too? We could know as soon as Monday at 10 a.m.
