[EL] question on resource advocating election law ambiguity be settled before partisan juices flow

Michigan claims the Libertarian lawsuit over whether presidential primaries are covered by sore loser laws is not important enough for the 6th circuit to grant a rehearing.  Does anyone know any scholarly article, or precedent, that makes the somewhat obvious point that these ambiguities in election law should be cleared up before we are in the midst of an actual raging partisan controversy?
