    Redistricting road for Texas state Senate map comes to an end

Readers may remember that, almost exactly two years ago, Texas decided 
to seek preclearance for its redistricting plans --- including the state 
Senate plan --- in a DC federal court, rather than submitting the plans 
to the Department of Justice.  The DOJ announced that it had no 
objections to the Senate plan, which meant that if Texas hadn't gone 
straight to court, its Senate maps would have been presumptively legal.

By the time the plan got to court, though, Senator Wendy Davis --- the 
same Senator Davis who broughtfilibuster madness 
<http://electionlawblog.org/?p=52196>to Austin just last week --- had 
intervened, claiming that the dismantling of the district she 
represented should block preclearance.  TheDC court agreed 
<http://electionlawblog.org/wp-content/uploads/texas-redistricting-district-court.pdf>. 
And in an effort to cobble some plan together in time for the 2012 
election, a San Antonio federal courtadopted interim maps 
<https://docs.google.com/open?id=0BxeOfQQnUr_gUzhBbE82dDRUaHlQSDdCdUhPZVdmdw>that 
amounted to a compromise between Senator Davis and the State.

On Wednesday, Governor Perrysigned new redistricting maps 
<http://electionlawblog.org/?p=52280>into law, including a state Senate 
plan modeled largely after the federal court's interim plan above and 
preserving Davis's district.  The next day, Senator Davis filed 
anadvisory with the federal court 
<http://redistricting.lls.edu/files/TX/20130627%20senate%20advisory.pdf>, noting 
that she did not plan to lodge further substantive protests to the new plan.

And so, two years after it began, the dispute over the Texas Senate plan 
is winding down --- at least, that is, until Texas decides to 
re-re-redraw the maps. Meanwhile,litigation over the congressional and 
state House plans <http://redistricting.lls.edu/cases-TX.php#TX>is still 
plenty active.

Unsurprisingly,a take somewhat different

that of the NY Times.  Surprisingly, in pointing out that things are not 
"just fine" in Boston and Cook County, it seems to be calling for 
enhanced federal (or at least statewide) action.

This opinion piece 
<http://www.realclearpolitics.com/articles/2013/06/28/voting_rights_ruling_it_had_to_happen_sometime_119000.html>repeats 
a claim I've heard often recently: section 5 buttressed Republican 
political fortunes by helping Republicans with control over 
redistricting overpack Democrats; now, things will change.

That's a claim that still strikes me as wrong.  If Republicans with 
control of redistricting had the incentive to overpack Democrats when 
section 5 was in place, I'm not sure why they would suddenly lose either 
the incentive or the possibility now.

Cid Kallenwas appointed yesterday

replace Jose Herrera as one of the five commissioners on Arizona's 
Independent Redistricting Commission.  Keep in mind that the commission 
has already drawn state and federal districts for this cycle, so Kallen

  Now, without the need to preclear their use in upcoming municipal 
elections.  For elections technology in New York, time doesn't seem to 
pass: it just is.

I do have a question about the legality of the move.  HAVA offered funds 
for jurisdictions to replace their punch card and lever voting systems. 
  States that took the funds, as a condition on those funds, had to 
ensure that "all of the punch card voting systems or lever voting 
systems" in precincts where those systems were used in 2000 would be 
replaced by either 2004 or 2006.  (42 USC 15302(a)(3))  New Yorktook 
more than $49 million 
<http://www.eac.gov/assets/1/Documents/FY2010%20Grants%20Report%20FINAL.pdf> in 
federal funds to replace its lever machines.

So ... is the thought that HAVA requires that lever machines be replaced 
(in states taking the money), but doesn't prohibit bringing them back?

This is the title of a remarkable website

Rights Act.  It generously incorporates multimedia exhibits taken from 
primary sources, and looks to be an exceptional resource.

And what really blows my mind is that the site's authors are FIFTEEN 
YEARS OLD.  That's right: 15.

Priya Ramamoorthy, Maanasa Nathan, Kavya Ramamoorthy, and Smrithi 
Mahadevan areseniors 9th graders, I believe, at Westwood High School in 
Austin, TX.  Their efforts won them theHistory of Congress Award

This <http://lexpolitico.com/?p=241>is an appeal to the decision 
inCatholic Leadership Coalition of Texas v. Reisman 
<http://lexpolitico.com/wp-content/uploads/2013/06/20130531-ORDER-granting-and-denying-summary-judgment.pdf>. 
  Plaintiffs had challenged two provisions: a corporate/labor 
contributions ban, and a requirement that PACs appoint a campaign 
treasurer 60 days before making expenditures or contributions.  The 
federal district court upheld both provisions.
