    Striking Section 5 Would Be Bad, But Would Not Return Us to 1964

makes the point nicely, a good response to HuffPo's breathless headline 
of the other day "Back to 1964?" But some things would get worse. Curry 
writes: " Would parts of the country now covered by section 5 revert to 
the days of poll taxes, literacy tests, murders of voter registration 
workers, racial gerrymandering of districts, and other devices to negate 
the power of African-American, Latino and other minority voters?"

We won't see poll taxes because of a constitutional amendment and a 
Supreme Court decision.  Another part of the VRA bars literacy tests (a 
provision which the Supreme Court upheld). Fortunately, racial tensions 
are no longer such that murders of voter registration voters will be on 
the horizon.

But would we see a change in behavior?  I suspect we will. For example, 
I would expect there to be fewer majority-minority districts but those 
districts will be packed with more minority voters (to help Republicans 
elect more reperesntatives overall).  Formerly covered States and 
localities will make voting changes, like consolidating polling places, 
cutting back on voter registration, implementing tough voter id rules, 
and other changes which (1) will automatically go into effect without 
DOJ or court approval and (2) some of which will be very difficult to 
challenge under section 2 of the VRA

or any other constitutional or statutory provision.

So let's not exaggerate the Bull Connor's and the police dogs.  But 
let's not pretend that eliminating section 5 would be no big deal either.

Rob Richie of FairVote sent this follow-up to the election law listserv 
(reprinted here with permission):

    As an addendum. Since we posted Andrea's blog last night, True the
    Vote has changed its report, but with nary an apology for its huge
    error that was widely reported in the conservative blogosphere. See

    The report authors now simply say in the section of the report that

    Note that Michael McDonald's turnout data on 2012 has been available
    for weeks. But True the Vote chose to use his data only for 2008 and
    then use turnout of registered voters for 2012.

    Perhaps someone should take a look at its other findings in its
    report on voter complaints.

    We were both in the courtroom yesterday for the oral argument in the
    Shelby County, Alabama, voting rights case, and were particularly
    struck by one aspect of the arguments:  the strange persistence of
    the myth that Section 2 of the Voting Rights Act is an adequate
    substitute for Section 5.  The working theory seems to be that if
    Section 5 is declared unconstitutional or the coverage formula in
    Section 4 is struck down, there's always Section 2 of the Act.  We
    call that a theory because there is no basis in reality for
    believing it.

    Solicitor General Don Verrilli told the Justices that Section 2
    cases are not an adequate substitute for Section 5, emphasizing that
    the voter has to bear the burden of proof and other heavy burdens,
    including cost.  Attorney Debo Adegbile followed that up with the
    point that Sections 2 and 5 work in tandem, with Section 5 often
    needed to insure that gains won in Section 2 cases are protected.

     From our own perspective as two lawyers with more than a hundred
    Section 2 cases in our combined nearly 90 years of practice (forty
    years plus each), we have some points we think are important to
    consider as the Justices decide this case.  We would also note the
    importance of Supreme Court cases like /United States v. Raines/.

    February 27 concluding that voter ID laws and other election changes
    allegedly meant to reduce voter fraud not only did not have an
    adverse impact on turnout in the 2012 elections, but may have helped
    to increased turnout. Its findings have been trumpeted by many news
    outlets who do not believe such laws suppress voter turnout.

    But it turns out the report's authors made a huge methodological
    mistake. They compared turnout of /eligible /voters in 2008 to
    turnout of /registered /voters in 2012. Correcting this error
    reverses their findings. All but one of the states with these new
    laws experienced a decline in voter turnout, and most experienced a
    decline greater than the national turnout decline from 2008 to 2012.

Demos has released a new report 
<http://www.demos.org/stacked-deck-how-dominance-politics-affluent-business-undermines-economic-mobility-america>. 
The takeaway, according the Center for Public Integrity 
<http://www.publicintegrity.org/2013/02/28/12249/report-campaign-law-changes-hasten-power-imbalance-between-rich-poor>, 
is that "The U.S. political system is increasingly gamed against 
Americans of modest means --- a situation exacerbated in recent years by 
major changes in the nation's campaign laws."

to put political equality back at the table in the discussion of 
campaign finance balancing, along with First Amendment rights of speech 
and association as well as concerns about corruption and conflict of

Anthony Johnstone has posted recent Senate testimony

Here is the abstract:

    This testimony concerns the role of the Supreme Court in reviewing
    the constitutionality of "laws of democracy," including campaign
    finance regulation, election administration, and voting rights
    enforcement. It compares the different approaches the Court has
    taken toward two controversies, corporate campaign spending and
    voter identification laws, and attempts to draw some lessons from
    the comparison for the Court's pending review of the Voting Rights Act.

The flood of traffic to the blog over the last few days has necessitated 
a move to a larger server. While it is gratifying that this blog has 
attracted more readers, there will be some short-term pain.  Once the 
migration begins to a new server (likely later today), there will be 
about a 24-hour period where no new posts will appear on the blog. Once 
the migration completes, to reach the new server (using the same 
electionlawblog.org address) you may need to restart your browser or 
clear your cache.

During that period of no posting, I'll still be writing on Twitter, 
@rickhasen, and if I have significant substantive posts, I may put them 
up temporarily on the backup site (electionlaw2.blogspot.com 
<http://electionlaw2.blogspot.com/>). I'll flag those posts with tweets.

Sorry for the inconvenience, and back to you very soon (I hope).
