The court led by Chief Justice John G. Roberts Jr. has so far been
consistently hostile to campaign finance limits in its half-dozen
decisions in argued cases on the subject so far. The five more
conservative justices have voted together in all of those cases,
though Chief Justice Roberts and Justice Samuel A. Alito Jr. have
taken a more incremental approach than the bolder one called for by
Justices Antonin Scalia, Clarence Thomas and Anthony M. Kennedy.
Justice Kennedy, the swing vote in other areas of the law, has long
been a skeptic of campaign finance restrictions. "Buckley has not
worked," he wrote in 2000

of aggregate limits have hope of a victory or a limited loss, it
probably rests with Chief Justice Roberts.

I think the answer to Rick's question about the DOJ North Carolina
complaint is this: The Department of Justice doesn't have general
authority to enforce constitutional rights; it needs a specific statute
authorizing it to do so. And I'm not aware of any statute that
generally authorizes DOJ to bring a proceeding to enforce constitutional
rights in voting outside of the race context. (Compare 42 USC 14141
<http://www.law.cornell.edu/uscode/text/42/14141>, which gives DOJ
general authority to bring constitutional claims against law enforcement
agencies, or the Civil Rights of Institutionalized Persons Act
<http://www.justice.gov/crt/about/spl/cripastat.php>, which gives DOJ
general authority to bring constitutional claims involving the treatment
of prisoners and other institutionalized persons.) So I don't think
it's a matter of DOJ not wanting to go there so much as not being able
to go there.

I'm wondering why the DOJ did not raise a constitutional claim in its
complaint <http://t.co/dOKCLWkZwg> against both early voting and the
wrong precinct provisional balloting issue. There were two important 6th
circuit cases just before the 2012 elections coming out of Ohio which
would offer an important alternative path to get some relief here. But
they are not race-based arguments, and perhaps DOJ didn't want to go there.

As regular ELB readers know, I do most of the posting here, but I have a
number of contributors who also write occasional and very insightful posts.
Readers continue to get confused about authorship, believing everything
on ELB is authored by me.
To try to lessen this problem, we've increased the size, and changed the
color and boldness, of the author name. I am hoping this helps to
lessen the confusion.
As always, we welcome feedback on how to make the blog more readable and
user-friendly.
