legal battle over campaign finance activities in the 2002 election

    Say you owned a business, and found out one of your employees was
    taking money out of the cash register and spending it on
    questionable ventures without telling you. You'd fire him, right?
    It's a pretty clear-cut case of right and wrong. Now imagine that
    you aren't allowed to know whether that employee is taking money out
    of your profits, or where the money is going.

    Sound unfair -- and like a bad way to run a business? Sadly, that's
    the case for shareholders -- owners of the largest corporations in
    America -- who'd like to know how their profits are being spent on
    political causes.  Now Sens. Robert Menendez (D-N.J.) and Elizabeth
    Warren (D-Mass.) are holding a briefing to explain why shareholders'
    need this information in their hands.

Here is the abstract:

    Disclosure laws require individuals and organizations that spend
    money on political speech to make public their identities. The
    Supreme Court and many others laud disclosure for shining light on
    money in politics and combating quid pro quo corruption. But that
    support may be misplaced. While disclosure provides information to
    law enforcement and the general public, it also provides information
    to corrupt actors. Disclosure records can tell politicians which
    private actors support compliant candidates, and the records can
    help private actors determine which politicians reward their
    benefactors. Disclosure can thus bring conspirators together and
    reduce the uncertainty that inheres in illegal transactions. That
    means disclosure has cross-cutting effects. It can deter corruption
    by increasing the likelihood of exposure, but it can also raise the
    benefit of corruption by increasing the certainty that parties to
    corrupt deals will keep their promises. When the second effect
    trumps, disclosure increases corruption. This analysis has
    implications for scholarship and law, including the upcoming
    McCutcheon case. It suggests that policymakers and judges should be
    less optimistic about disclosure and open to alternative
    corruption-fighting measures.

    use volunteers to gather signatures would also create a right for

    alleging fraud was used to get the signatures, potentially allowing

The debate over whether the rise of increasingly safe seats for members 
of Congress contributes to political polarization remains ongoing.  
Political scientists, through empirical studies, tend to conclude there 
is no significant contribution.  On the ground political actors often 
assert there is (the issue of safe seats is not necessarily the same as 
that of gerrymandering --- seats could be increasingly safe because of 
greater geographical sorting that correlates with political views, ie, 
liberals increasingly concentrate in cities).  In that light, Ezra 
Klein's interviewtoday

with Robert Costa, whom Klein calls "one of the best-sourced reporters 
among House Republicans" might be of interest.  The key excerpt/:/

    *EK: Why does that happen, though? It would absolutely be possible
    for liberal members to cocoon themselves in a network of liberal Web
    sites and liberal cable news shows and liberals activists. But in
    the end, liberal members of Congress end up agreeing to broadly
    conventional definitions of what is and isn't politically realistic.
    So how do House Republicans end up convincing themselves of
    unrealistic plans, particularly when they've seen them fail before,
    and when respected voices in the Republican and even conservative
    establishment are warning against them?*

    RC: When you get the members off the talking points you come to a
    simple conclusion: They don't face consequences for taking these
    hardline positions. When you hear members talk candidly about their
    biggest victory, it wasn't winning the House in 2010. It was winning
    the state legislatures in 2010 because they were able to redraw
    their districts so they had many more conservative voters. The
    members get heat from the press but they don't get heat from back home.

    in arguing that, if in /McCutcheon/ the Supreme Court were to strike
    down the aggregate limit on political contributions, the large
    individual donor would be able to amass undesirable influence by
    donating to joint fundraising committees organized by candidates and
    parties. The money distributed through those committees is governed
    by limits---$2600 per participating candidate, etc.---but when first
    given to the joint fundraising committee, the total donated might be
    massive, in the millions, and the parties and candidates who would
    divide it up later could be insidiously grateful to the donor.

    If the aggregate limit is a means of enforcing the base limits and
    blocking circumvention, it raises the question: how effective does
    an anti-circumvention measure have to be to prevail in a test of the
    provision's constitutionality? In the case of the aggregate limit,
    the inquiry leads quickly to a consideration of a new fact of
    campaign finance---the super PACs.

the importance of the Chief Justice in this case. He writes:

    The court led by Chief Justice John G. Roberts Jr. has so far been
    consistently hostile to campaign finance limits in its half-dozen
    decisions in argued cases on the subject so far. The five more
    conservative justices have voted together in all of those cases,
    though Chief Justice Roberts and Justice Samuel A. Alito Jr. have
    taken a more incremental approach than the bolder one called for by
    Justices Antonin Scalia, Clarence Thomas and Anthony M. Kennedy.

    Justice Kennedy, the swing vote in other areas of the law, has long
    been a skeptic of campaign finance restrictions. "Buckley has not
    worked," he wrote in 2000
    <http://www.law.cornell.edu/supct/html/98-963.ZD.html>. If defenders
    of aggregate limits have hope of a victory or a limited loss, it
    probably rests with Chief Justice Roberts.
