Marty, thanks for referencing my work. In this post, based on my book, I
highlight how the SG was pressured during the ACA arguments to make certain
weak originalist arguments and, to his credit, resisted that pressure.

 I think we saw a similar dynamic at play in McCutcheon.

Also to Sam's point, It's not clear exactly what brand or originalism or
textualism Lessig was using. He was using the founding generation's
understanding of corruption to give meaning to a term introduced by the
Burger Court. I'm not sure how relevant that history is here. See
