When Judge Posner's opinion came out I condemned it in the /Washington
Post/ aspernicious

and urged the Supreme Court to take the case. One should be careful
what one wishes for, given what the Court did in the case.

The Sunlight Foundation's Influence Explorer now offers a new way to
review and receive federal campaign finance data for candidates,
PACs and outside spending groups. The "Realtime Federal Campaign
Finance" section---Realtime for short---of Influence Explorer takes
official Federal Election Commission (FEC) data for the current
election cycle and presents it in a more user-friendly format.
The Realtime tool, which is actually an amped-up version of
Sunlight's "Follow the Unlimited Money," automatically gathers FEC
data. It presents spending by and for politicians, parties, PACs and
Super PACs.
This site also allows users to receive customized email alerts when
a particular committee submits a new electronic filing to the FEC.
The new Realtime section is Sunlight's first step in providing more
immediate data offerings on Influence Explorer. Other tools that
were developed for the Sunlight Foundation Reporting Group will be
rolled into this site in the coming months.

On October 16th -- a Wednesday, no less -- New Jersey voters are
being asked to go to the polls to select a new U.S Senator to
replace Jeffrey Chiesa, Gov. Chris Christie's stand-in for the
long-time Democratic Senator Frank Lautenberg, who died earlier this
year. Bizarrely, this oh-so-special election takes place just 20
days before these same voters will be asked to return to the polls
for the regularly scheduled election for governor and state legislature.
The cost to New Jersey taxpayers? Some $12 million. The adverse
impact on voter turnout for having two separate elections in 20
days? Significant. The partisan calculation behind the election
date? Blatant.

That helps me to understand where Larry is coming from; I had thought

would ask a different question in McCutcheon: "would the Framers have
considered it to be an "abridgement" of "freedom of speech" to limit
campaign spending (or contributions)?"

We have in currency two explanations for why the Supreme Court will
not give campaign finance regulation more room: the Justices do not
understand politics, and they have missed a critical Constitutional
principle. These views of the Court's performance have it faltering
on either the facts or the law. In the one case, the solution is to

the other, it is to get the attention of the Court and bring it to
enlightenment or expose its originalist inconsistencies.

Advocates of the second want the Court to correct the error of its
