makes the key point:

    But the returns also reflect a significant shift in the tax
    strategies the Koch operation deploys to avoid challenge from the
    Internal Revenue Service, which limits how much nonprofit groups can
    spend to aid or defeat candidates.

    Other donor clearinghouses, along with nearly all of the political
    groups they support, register with the I.R.S. as "social welfare"
    groups under Section 501(c)4
    <http://www.irs.gov/pub/irs-tege/eotopici03.pdf> of the tax code.
    That has let such groups spend money on elections while keeping
    their donors secret --- drawing increasing regulatory and
    legislative scrutiny from critics who assert that some of the groups
    are violating campaign laws.

    But Freedom Partners established itself in November 2011 as a501(c)6
    <http://www.irs.gov/pub/irs-tege/eotopick03.pdf> "business league,"
    typically a trade association of corporations, like the Chamber of
    Commerce, organized to promote a common business interest. Instead
    of donors, it has more than 200 "members," each making a minimum
    $100,000 contribution, which Freedom Partners classifies as member
    dues. The approach gives it many of the same advantages social
    welfare groups have, with one significant addition: Some
    contributions to the group may be tax deductible as business
    expenses

This is why I long been saying (see my testimony 
<http://electionlawblog.org/?p=32374> regarding DISCLOSE ACT II) that 
effective campaign finance disclosure reform must target the nature of 
the activity not the organizational form a group takes. Otherwise, as 
Roy Schotland argued <http://electionlawblog.org/?p=16127> a few years 
ago, the Koch Bros and others would just form a veterans group under 
501(c)(19) or take some other form.

    Amendment and for responsible law-making. Although guns were the
    reason for the recall campaign, Senate President John Morse of

    Senator Angela Giron of Pueblo lost primarily because they misused
    their powers, not for any stand on principle. Their misjudgments may

    that the trend towards disenfranchising legislation has not only
    continued but accelerated following the Supreme Court's recent
    ruling on the Voting Rights Act.

Here is the abstract:

    The political activities of Section 501(c)(3) organizations are
    often in the news, with allegations made that some groups engaged in
    impermissible activities. These groups are absolutely prohibited
    from participating in campaign activity under the Internal Revenue
    Code (IRC). On the other hand, they are permitted to engage in
    nonpartisan political activities (e.g., distributing voter guides
    and conducting get-out-the-vote drives) that do not support or
    oppose a candidate.
    Determining whether an activity violates the IRC prohibition depends
    on the facts and circumstances of each case, and the line between
    impermissible and permissible activities can sometimes be difficult
    to discern.
    Due to the IRC prohibition, Section 501(c)(3) organizations
    generally are not permitted to engage in the types of activities
    regulated by the Federal Election Campaign Act (FECA). However, the
    activities regulated under the IRC and FECA are not necessarily
    identical. An organization must comply with any applicable FECA
    provisions if engaging in activities regulated by FECA (e.g., making
    an issue advocacy communication under the IRC that constitutes an
    electioneering
    communication under FECA).
    A 2010 Supreme Court case, Citizens United v. FEC, has received
    considerable attention for invalidating several long-standing
    prohibitions in FECA on corporate and labor union campaign treasury
    spending. This case does not appear to significantly impact the
    political activities of Section 501(c)(3) organizations because they
    remain subject to the prohibition on such activity under the IRC.
    This report examines the restrictions imposed on campaign activity
    by Section 501(c)(3) organizations under the tax and campaign

    Republicans and Democrats are getting ready to spend 14 months and
    hundreds of millions of dollars on a House campaign that is likely
    to end in a split decision with a small gain for one party or the other.

    Because redistricting has given the parties --- primarily
    Republicans --- lopsided control of many districts and a working
