for the SCOTUSBlog /McCutcheon /symposium. It begins:

    Chief Justice Roberts has moved the Supreme Court's election law
    jurisprudence steadily and stealthily in his preferred direction.
      Usually this involves subtle shifts in doctrine, the planting and
    later reliance on key dicta, and hints of future lawsuits to come.
    This is as true of Roberts's opinions in the voting rights arena as
    it is in campaign finance.  As I explain at /Slate/

    yesterday's decision in /McCutcheon v. Federal Election Commission
    <http://www.scotusblog.com/case-files/cases/mccutcheon-v-federal-election-commission/?wpmp_switcher=desktop>/
    uses all of these tools.  The Chief's opinion constricts the
    definition of corruption, ramps up ever so subtly the scrutiny of
    contribution limits, and all but invites a challenge to the
    remaining pillar of the McCain-Feingold law:  the soft money ban.
      It is hard to see what will be left of campaign finance law beyond
    disclosure in a few years.

    In this post I wanted to focus on a different tool the Chief Justice
    uses in these controversial election cases:  ostensible reliance on
    the political branches to militate the harshness of the Court's
    opinions.

    *WE CHECKED THE CONSTITUTION, AND...*

    Much has happened on the money side of national politics in the last
    four years, but the Supreme Court made it very clear on Wednesday
    that the First Amendment remains a high -- and perhaps rising --
    barrier to close regulation of campaign dollars.  Four years ago,
    the Court's decision in /Citizens United v. Federal Election
    Commission/ created a constitutional opportunity that turned into
    almost uncountable millions flowing into races for Congress and the
    presidency in the main, but also in local campaigns.

    Although Chief Justice John G. Roberts, Jr., in the main opinion in
    the new ruling in /McCutcheon v. Federal Election Commission/, went
    to considerable lengths to keep the decision within fairly narrow
    bounds, it does have potential implications for future campaign
    finance cases. Given that there are platoons of very energetic legal
    advocates working to push the First Amendment a good deal further in
    this field, those implications are sure to be tested....

    Because "improper dependence" is precisely the problem that limits
    on aggregate contributions are meant to attack. Already we have a
    system in which Congress is dependent upon the tiniest fraction of
    the 1% to fund its campaigns. I've estimated the number of relevant
    funders is no more than 150,000 (about the number of Americans named
    "Lester.") If aggregate contribution limits are struck, that number
    will fall dramatically. More will be raised from a smaller number of
    contributors---maybe as few as 40,000 (about the number of Americans
    named "Sheldon"). So abolishing aggregate limits will move us from
    Lesterland <http://lesterland.lessig.org> to Sheldon City,
    increasing a dependence on the funders, while conflicting with
    Madison's promise of a branch of government "dependent on the people
    alone."

    That argument may or may not have worked with one of the five
    conservatives on the Court. There's no such thing as a slam dunk in
    law, and this argument depends upon originalism applied not to the
    Constitution's text, but to the standard the Court uses to interpret
    that text.

    But the striking fact about /McCutcheon/ is that the government
    didn't even try. Originalism is not the language of liberals. It's
    beneath them---the weapon of the enemy. So the government's brief
    didn't even hint at the argument that there was no good originalist
    reason to restrict the meaning of "corruption" to quid pro quo
    corruption alone. And Justice Breyer in his classically geeky
    dissent doesn't even hint at the possible originalist
    inconsistency---even though the core of his argument is precisely
    that "corruption" does not mean "quid pro quo corruption" alone.
