[EL] FOIA Suit and Information Quality Petition Filed against IRS c4 NPRM

Today Cause of Action, a D.C.-based 501(c)(3) organization heavily involved
in FOIA and similar investigative activities, _www.causeofaction.org_
(http://www.causeofaction.org) , filed suit against the IRS for failure to
respond to FOIA requests for background documents on the development of the
Notice of Proposed Rulemaking on the proposed regulations creating a new
"candidate-related political activity" definition governing activities by
Section 501(c)(4) tax-exempt organizations. The suit cites prior filings of some
petitions and suits previously covered on this list, and the IRS's
response to those petitions and suits.

Though the rhetoric in the Complaint is heated, the FOIA claim is solid.
Seeking, among other things, the "unsolicited public comments" that the IRS
press release says it relied upon in crafting the proposed regulations and
any correspondence with the commenters, the FOIA requests, coupled with the
Paperwork Reduction Act claims made in comments filed earlier and
referenced in the Complaint, are likely to be granted.
