The Court divided 6-3 in this order <http://t.co/TqCwSavjDC>, with
Justice Sotomayor writing a dissent for herself, Justice Ginsburg and
Justice Kagan. Justice Breyer, who joined these three in dissent in
Hobby Lobby, did not dissent in this order.

Yesterday I explained <http://electionlawblog.org/?p=62967> why, at
least on first look, True the Vote's attempt to gain access to the poll
books under the NVRA looks weak.
Today a reader passes alongthis 2009 decision from a federal district
court

from the Southern District of Texas. It does not speak to whether poll
books are the types of records. But it does read the NVRA's public
disclosure provisions narrowly. Again, it does not support TTV's position.

Justin Levitt, a professor at Loyola Law School, Los Angeles, and an
expert in national election law, said he believes a thorough review
of election records will reveal fewer illegal votes than skeptics of
the runoff claim.
Levitt said that partial election records, like those reviewed by
True the Vote and McDaniel supporters, can often overstate voter
fraud, which is later revealed as clerical error or due to voters
with identical names and birth dates --- which Levitt said is
actually very common.
"It's always difficult to predict what is going to happen," Levitt
said. "They can give more or less of a thumbs up or down on each of
the lawsuit's claims."
