""My initial reaction is I thought it was a headline from 'The Onion.'
Now I see how this group has earned their awful reputation."

--Joe Nosef, Mississippi State Republican Party Chair, reacting
<http://www.clarionledger.com/story/politicalledger/2014/07/09/mcdaniel-cochran-true-vote-lawsuit-hosemann/12425643/>
to news <http://electionlawblog.org/?p=63159> that True the Vote had
sought a restraining order against the party related to the disputed
#MSSEN race.

I must say, it is fascinating to see an all-Republican version of "The
Voting Wars." (Of course the villans still in this case are
African-American/Democratic voters....but still!)

Press release via email:

    True the Vote <http://www.truethevote.org/> (TTV), the nation's
    leading voters' rights and election integrity organization, today
    filed a motion
    <http://www.scribd.com/doc/233274259/True-the-Vote-v-Mississippi-Motion-for-TRO>
    with the Jackson Division of the U.S. District Court, requesting
    temporary restraining order and injunctive relief be issued against
    the Mississippi Republican Party and all defendants to prevent
    further tampering, redaction, or destruction of voter records by
    Defendants or their agents.

    "Defendant county commissioners have continued to violate federal
    law by preventing access to election records. Now, we think we know
    why," said True the Vote <http://www.truethevote.org/> founder,
    *Catherine Engelbrecht*. "If the affidavits we now have regarding
    the *destruction of election documents* and other similarly stunning
    findings are true, then no Mississippian, no American, can trust the
    results of this election."

    True the Vote will be providing the Court with dozens of
    full detailed affidavit reports, containing stunning evidence of
    election subversion, including:

    ü Destruction of voters' absentee ballot applications and
    mandatory envelopes;

    ü  Illegal alteration of poll books;

    ü  Cross-over and double voting;

    ü Absentee ballots marked "Accepted" but unopened.

    "Based on all we have seen --- and all we have not been allowed to
    see --- we now believe that unless the Court steps in, illegal
    voting will go unchallenged, voters' rights will be diluted,
    voters' trust will be violated -- and an unlawful and inaccurate
    election may be certified by the State of Mississippi," said
    *Engelbrecht*.

    TTV's motion
    <http://www.scribd.com/doc/233274259/True-the-Vote-v-Mississippi-Motion-for-TRO>
    was filed in the United States District Court for the Southern
    District of Mississippi, Jackson Division.

    A copy of the motion has been made available here
    <http://www.scribd.com/doc/233274259/True-the-Vote-v-Mississippi-Motion-for-TRO>.

    Media Apparently Misstate Extent of Dodgers Liability in Brian Stow
    Case <http://electionlawblog.org/?p=63142>

Posted on July 9, 2014 2:29 pm <http://electionlawblog.org/?p=63142>by
Rick Hasen <http://electionlawblog.org/?author=3>

Just now a jury awarded $18 million to Brian Stow for the 2011 beating
Stow took at Dodger Stadium. According to press reports, the jury found
the Dodgers 25% responsible, and each of the two attackers 37.5 percent
responsible. AP
<http://news.yahoo.com/dodgers-found-partly-responsible-fan-beating-204952538--spt.html>says:
"The jury found damages of about $18 million but said the Dodgers were
responsible for only a quarter of the sum. The rest of the
responsibility was split between the two men who beat fan Bryan Stow."
CBS
<http://losangeles.cbslocal.com/2014/07/09/jury-reaches-verdict-in-bryan-stow-trial/>
says: "The verdict means the Dodgers business entity must pay about $4.5
million." ABC
<http://abc7.com/news/bryan-stow-civil-trial-jury-reaches-verdict/172169/>
says: "Jurors awarded Stow about $18 million in damages, which means the
Dodgers must pay about $4.5 million."

They are all wrong.

Under California law, to the extent that the $18 million represents
compensation for "economic" damages (that is, past and expected future
medical expenses, lost wages, etc.), principles of "joint and several
liability" apply. That means, assuming the two other defendants have no
assets, the Dodgers are on the hook for the entire amount of the damages.

California voters passed an initiative providing that for non-economic
damages (that is, pain and suffering, and emotional distress), damages
are "several" only, meaning the Dodgers only pay 25% of this subset of
damages.

I do not yet know how much the jury allocated for economic vs.
noneconomic damages. Surely Stow has much of both. But how that is
allocated determines just how much the Dodgers are on the hook for.

UPDATE; Apparently there is a bankruptcy order involving the Dodgers
further complicating this.  Stay tuned.

UPDATEII: The AP story now says: "Plaintiff's attorney Tom Girardi said
the verdict means the Dodgers must pay about $14 million in economic
losses and a quarter of the pain and suffering sum, adding about $1
million more."

UPDATE III: Here is a bankruptcy consent order
<http://electionlawblog.org/wp-content/uploads/Dodgers-Stow-Consent-Order.pdf>
in which the Stow family agrees to go after money only from 17 Dodgers
insurance policies. The policies were filed under seal, so it is not
clear if it can cover all of the damages. There also may be other
filings in the bankruptcy case which affect the right to recover.
Thanks to ELB reader David Bury for passing this along.

Press release via email:

**

    *JACKSON, MS. --- July 9, 2014:* True the Vote
    <http://www.truethevote.org/> (TTV), the nation's leading voters'
    rights and election integrity organization, today refiled its
    lawsuit against the Mississippi Secretary of State, the State
    Republican Party, and ten newly added county election commissions,
    asking the Court to immediately order election records be opened to
    inspection, as outlined in the federal election record maintenance
    and open records provisions codified in the National Voter
    Registration Act of 1993 (NVRA) (True the Vote, et. al v. State of
    Mississippi, et. al. (3:14cv532-HTW-LRA))
    <http://www.scribd.com/doc/232166906/True-the-Vote-v-Mississippi-Complaint>.

    True the Vote refiled in the Southern District of
    Mississippi, following the motion for relocation by Northern
    District Judge Michael P. Mills.

    In the refiling, True the Vote <http://www.truethevote.org/> added
    an additional 8 individual Mississippi voters as plaintiffs,
    bringing the total number of plaintiffs to 22.

    The following nine counties and their respective election
    commissions have been included as defendants in the case
    <http://www.scribd.com/doc/232166906/True-the-Vote-v-Mississippi-Complaint>:
    Copiah, Hinds, Jefferson Davis, Lauderdale, Leake, Madison, Rankin,
    Simpson and Yazoo.

    "Given the importance of the case, it was imperative that we move as
    expeditiously as possible so dismissal of our suit in the Northern
    District of Mississippi and re-filing in the Southern District
    avoids the potential delays in transferring the case," Beirne,
    Maynard & Parsons L.L.P. attorney *James E. "Trey" Trainor* said.
    "The Court in Oxford made it clear that Jackson would be a better
    venue to quickly resolve the serious issues we have brought before
    the Court."

    True the Vote <http://www.truethevote.org/> engaged legal
    representation with the firm of Beirne, Maynard & Parsons L.L.P.
    TTV's complaint was re-filed in the United States District Court for
    the Southern District of Mississippi, Jackson Division.

    A copy of the re-filed complaint has been made available here

    The precinct level returns in Hinds County
    <https://github.com/openelections/openelections-data-ms/blob/master/2014/20140624__ms__republican__primary__runoff__hinds__precinct.csv>
    bolster the theory that a surge in black, Democratic turnout allowed
    Senator Thad Cochran to defeat Chris McDaniel, a Tea Party-backed
    state senator, in last month's Republican primary runoff in Mississippi.

    Mr. Cochran won by 6,693 votes. More than half --- a net 3,532 votes
    --- came from the most Democratic precincts in Jackson's Hinds
    County, where President Obama won a combined 97.8 percent of the
    vote in 2012, according to figures released Tuesday night by the
    Mississippi secretary of state.
