Richard,

You say in the article that “[t]he only difference between that case [the 1984 AFL-CIO v. Eu case] and the new case, is that the 1984 measure was put on the ballot by the voters, whereas the current measure was put on the ballot by the legislature.”  But that’s a pretty significant difference, not an “only”:  The people’s right of initiative under the California Constitution is expressly limited to proposing legislation, whereas the Legislature’s authority is not so limited, but encompasses all powers incidental to its legislative function.  Nor is this the first time that the California Legislature has placed an advisory measure on the ballot, as the Howard Jarvis writ petition itself notes.
