[EL] contractor ban query

Can anyone tell me the status of the Wagner case?  I see in 2013 the 
D.C. Circuit ordered as follows: " For the foregoing reasons, it is 
*ORDERED* /sua sponte/ that the judgment of the district court be 
vacated and the case remanded to the district court to make appropriate 
findings of fact, as necessary, and to certify those facts and the 
constitutional questions to the /en banc/ court of appeals within five 
days of the date of this opinion."
But I don't see what happened next.
