I don't think this is entirely unintended, or if not intended, certainly something pro-regulation interests can use. Pushing political activity from one mechanism to another gives those seeking to regulate as much speech as possible the ability to say--as each new or previously moribund avenue of speech becomes an alternative--"more needs to be done." As the article references, campaign contributions led to soft money led to 527s led to SuperPACs led to 501(c)(4)'s leads to whatever people will think of next to attempt to peacefully exercise their fundamental First Amendment rights without governmental interference. Whatever that vehicle will be will undoubtedly be proclaimed a threat to democracy and prompt calls for the government to get going on whatever the more du jour is.
