    "Supreme Court faces wave of free-speech cases from conservatives"

    This year's Supreme Court term features an unusual array of
    potentially powerful 1st Amendment claims, all of them coming from
    groups on the right.

    And in nearly every case, liberal groups --- often in alliance with
    the Obama

    administration --- are taking the opposing side, supporting state
    and federal laws that have come under attack for infringing upon the
    rights of conservatives.

    The free-speech challenges include cases on campaign contribution
    limits, no-protest zones in front of abortion clinics and mandatory
    union dues for public employees.

    At the same time, devout Christian employers are claiming their
    religious liberty should entitle them to an exemption from a
    provision in President Obama's healthcare law

    requiring that full contraceptive coverage be offered to female
    employees.

    And waiting on deck is a free-speech appeal from a Christian
    photography company challenging a New Mexico state law that bars
    businesses from discriminating against gays and lesbians.

    As usual, what's most interesting (at least to me) is what's next.
    Here's a short list:

     1. Does the EAC appeal in an effort to revive its authority to
        control the federal form and the accompanying instructions --
        and if so, do they prevail?
     2. Does the appeal make its way back to the Supreme Court and give
        Justices another opportunity to delineate federal and state
        election law responsibilities as they did in last summer's
        opinion in Arizona v. Inter Tribal Council

     3. Do more states enact proof-of-citizenship requirments as a result?
     4. Does the case give more incentive for states to consider online
        voter registration, which usually includes an
        eligibility/citizenship check

        as part of the process?
     5. What happens to the thousands of voters in who applied using the
        federal form before the lawsuit was decided? Can the states (and
        if so how) enforce the proof-of-citizenship law in time for
        those voters to cast ballots in this year's election?

    This is a big deal and is likely the starting gun for another round
    of disputes across the nation. Stay tuned!

    Last summer, the Supreme Court invalidated the Voting Rights Act's
    (VRA) most powerful provision, known as Section 5. And in the wake
    of that ruling, msnbc reported

    on signs that the right would next set its sights on the landmark
    civil rights law's other key pillar, essentially rendering the VRA a
    dead letter. That assault is now officially underway---just in time
    to stymie several high-stakes challenges to voter ID laws.

    Two leading conservative legal activists argued in a memo
    <http://www.heritage.org/research/reports/2014/03/disparate-impact-and-section-2-of-the-voting-rights-act>
    published this week by the Heritage Foundation that the provision at
    issue, Section 2, should be construed so narrowly that it would be
    able to stop only the most blatant forms of racial discrimination in
    voting. And the memo, written by Heritage's Hans von Spakovsky and
    Roger Clegg of the Center for Equal Opportunity, may aim to lay the
    groundwork for an even more far-reaching claim: The prominent
    election law scholar Rick Hasen, no alarmist on voting rights,
