...is bucking for Sunstein status. (If the title of this *Forbes* piece is
any indication).
That is not news to anyone on this listserv. But it is unfortunate that a
liberty-oriented Ralph Benko seems overly enamored. America's problem isn't
the Court's interpretations of the Constitution's First Amendment, it's the
interpretations of the Constitution's First Article. Benko, of all writers,
should know better. (I am betting Benko has written as much elsewhere).
My congratulations to Larry, who is promulgating his opinions and earning
his media, fair and square.
Still, I hope no lawmaker is 'unconsciously' swayed by it, which is a
variation on a theory Lessig expresses a little too often, a little too
boldly. Such swaying by this "Professor Lester" might constitute a kind of
"corruption" We, "the populists," ought to "do something" about.
So why do I get the sense Lessig would welcome the "do[ing]" -- as the
first step to spreading the precedent further...?
