On the relevance of the /Nader/ case, Michigan is apparently taking the 
position that it is unconstitutional to limit petition signature

    On May 6, Democracy 21 and the Campaign Legal Center (CLC) wrote you
    "to urge the Internal Revenue Service (IRS) to deny tax exempt
    status as a 'social welfare' organization to Crossroads GPS." By the
    authors' own accounting, this was the eleventh such letter submitted
    to the Service.

    The Center for Competitive Politics (CCP) writes in response. CCP
    takes no position on the granting or denial of tax-exempt status to
    any particular organization, nor do we think it appropriate for us,
    or others, to do so here. Consequently, we have not written you to
    rebut any of the previous ten letters submitted by Democracy 21 and
    the Campaign Legal Center. But because the most recent of these
    letters misrepresents the significance of the Federal Election
    Commission's First General Counsel Report in Matter Under Review
    (MUR) 6396, we write now.

    The American Law Institute's "Principles of Election Law" Project is
    a clear example of the ALI tackling a new and perhaps difficult
    field. This article elaborates on the main challenges and
    opportunities that this Project presents. It begins with a brief
    overview of some of the unique features of election law as a field
    of American law. In light of these features, it then discusses the
    Project's work on the subject of disputed elections, and the
    Project's efforts to develop best practices concerning non-precinct
    voting. It then offers some concluding thoughts about the
    development of principles of election law.

    Mr. D'Souza's attorney, Benjamin Brafman, had argued previously that
    Manhattan U.S. Attorney Preet Bharara's office had engaged in
    "selective" prosecution by targeting a Republican, a criticism also
    echoed by retiring Harvard law professor Alan Dershowitz.

    Prosecutors pushed back against the claim. Law Blog noted earlier
    that Mr. Bharara's office has won corruption convictions against
    nearly a dozen Democratic lawmakers in New York since President
    Barack Obama <http://topics.wsj.com/person/O/barack,-obama/4328>
    nominated him to the post in 2009.

    Judge Berman ruled last week that prosecutors had not engaged in
    selective prosecution.

    Mr. Brafman said in a statement Tuesday there was no "viable
    defense" for Mr. D'Souza because of the technical nature of the case.

When I teach campaign finance, I like to use the radio ads that were at 
issue in the case.  The ads used to be posted easily on the WRTL 
website, but they are no longer in the spot they used to be.  Thanks to

been dropped. In that instance, the district attorney found the felon 
and voter had the same name (or perhaps alias), address and birth date, 
but not the same driver's license number. The two are not the same

    It would have been refreshing if the group acknowledged that its
    very existence was a stain on the executive branch, and that its

U.S. Department of Justice and a group of plaintiffs, including the N.C. 
NAACP, are seeking to block provisions of North Carolina's voting laws 
that they say will keep blacks from voting in the Nov. 4 general 
election. Attorneys filed motions for a preliminary injunction late 
Monday night in U.S. District Court in Winston-Salem. At the same time, 
attorneys representing the state filed a motion asking a federal judge 
to throw out three lawsuits challenging the state's new voting laws."
