Rep. Conyers name to be put on the ballot.
I had said that Conyers had a very strong argument that the law limiting
petition circulators to residents was likely unconstitutional. The court
agreed today, holding that the case was indistinguishable from earlier
Sixth Circuit precedent, binding on the trial court, Nader v. Blackwell.

arguments that the state made to try to distinguish the /Nader/ case
seemed quite weak to me.
The big question in my mind was one of the doctrine of /laches/: did
Conyers wait too long to raise this question? The trial court rejected
the laches argument. Laches requires a showing of unreasonable delay in
filing suit and prejudice. The judge found neither, noting that there
was evidence the circulators who were not residents acted in good
faith. (I've been a strong proponent of greater use of laches
<http://electionlawblog.org/?p=27985> in election cases to prevent
candidates from having an "option" to challenge rules only if they
disadvantage them.)
We will now see if the State of Michigan takes this on expedited review
to the Sixth Circuit, or leaves it where it is. Time is short before the
printing of ballots.

Earlier today, Senator Mark Begich introduced a bill in the United
States Senate to protect Alaska Native voters from discrimination.
Senator Begich's bill, the "Native Voting Rights Act of 2014"
("NatiVRA"), would require close scrutiny of the closure of polling
places and voter registration in Native communities, mandate
acceptance by election officials of identification cards issued by
federally recognized tribes and Native corporations, and provide
increased protections for Native voters who cannot understand
complex voting materials written in English. The bill creates a
presumption of discrimination where Natives are denied equal access
to voting and registration opportunities provided to non-Natives.
Finally, it would enhance federal oversight of voting in tribal
areas and Native villages.

Government ethics groups come in all shapes and sizes. City Ethics,
an ordinary nonprofit, has a website with huge amounts of
information about government ethics, and no financial resources. The
American Dream Initiative, a social welfare organization founded
last year, apparently has large financial resources, but no website
and no information about government ethics.
I say "apparently" because, according to an article that went up
yesterday afternoon on the Austin /American-Statesman/ website
<http://www.mystatesman.com/news/news/out-of-state-ad-roils-texas-attorney-general-race/nf5s3/>,
the American Dream Initiative recently funded ads that cost about
half-a-million dollars criticizing a Texas attorney general
candidate. The ads, during the week before a run-off election, say
that the candidate, a state senator, was reprimanded by a securities
regulator for having taken kickbacks. They also ask viewers to
contact the candidate and tell him "to support ethics reform
legislation to make government honest."
The Initative's chair, Dan Backer, who represented Shaun McCutcheon
in his eponymous campaign finance case

told the paper that the Initiative is intended to champion
"traditionally conservative ideals," particularly "government ethics
reform. ... We're taking an opportunity, when people are paying
attention, to push the issue of government ethics reform." However,
the ads made no mention of any government ethics reform bill or even
subject. The candidate's violation was not of a government ethics
provision, but of securities-related provisions.
