    As Democrats struggled last week to salvage control of the Senate,
    they pushed to get as many black voters to the polls as possible

    especially in the South. It's no wonder: Blacks are the most
    reliable
    <http://www.washingtonpost.com/national/solid-black-turnout-not-enough-to-rescue-key-democrats/2014/11/04/a71ca6d2-647d-11e4-836c-83bc4f26eb67_story.html> Democratic
    voters, and 89 percent of them
    <http://www.washingtonpost.com/blogs/the-fix/wp/2014/11/06/the-gop-moved-the-ball-forward-with-black-voters-but-progress-is-slow/> ended
    up supporting Democratic candidates in the 2014 elections (a mark
    that was actually down from 2012). White voters, in contrast, came
    out heavily for Republicans in the South. In North Carolina, where
    incumbent Democrat Kay Hagan lost to Republican Thom Tillis, the GOP
    candidate got just 3 percent
    <http://www.washingtonpost.com/blogs/the-fix/wp/2014/11/06/the-gop-moved-the-ball-forward-with-black-voters-but-progress-is-slow/> of
    the black vote. But as we all know, the black turnout was not high
    enough to beat back the Republican wave in North Carolina or
    elsewhere. In North Carolina in particular, black turnout was down
    <http://www.washingtonpost.com/national/solid-black-turnout-not-enough-to-rescue-key-democrats/2014/11/04/a71ca6d2-647d-11e4-836c-83bc4f26eb67_story.html> compared
    with 2012.

    Recognizing this major overlap of race and party in the South is key
    to understanding Wednesday's Supreme Court case
    <http://www.scotusblog.com/case-files/cases/alabama-democratic-conference-v-alabama/?wpmp_switcher=desktop> involving
    a constitutional challenge to Alabama's legislative redistricting.
    No one disputes that the Alabama legislature packed black voters
    into a few legislative districts, thus strengthening Republican
    control in the majority of districts throughout the rest of the
    state. But whether or not that action is constitutional depends a
    great deal on whether the court views this as a case about race (in
    which case Alabama may have acted unconstitutionally) or one about
    party (in which case Alabama's actions are constitutional, if
    unsavory politics as usual).

    This review essay for the Yale Law Journal of Robert Post's Citizens
    Divided: Campaign Finance Reform and the Constitution contrasts
    Post's hopeful and optimistic vision of discursive democracy, and
    its accompanying hopeful and optimistic visions of the Constitution
    and the First Amendment, with the more fearful and risk-averse
    visions well-captured by Winston Churchill's famous observation that
    "democracy is the worst form of Government except all those other
    forms that have been tried from time to time." Although Post's
    vision is attractive in a more hopeful or even utopian way, the more
    pessimistic vision of democracy, of constitutionalism, and of
    freedom of speech, arguably exemplified in the title of John Hart
    Ely's Democracy and Distrust, is distrustful of government,
    distrustful of legislative power, distrustful of courts, and even
    distrustful of public discourse. And although this essay does not
    seek to determine as a matter of ideal theory which vision is
    superior, it does suggest that, pace Post, the vision of fear and
    distrust may fit better with existing American constitutional
    doctrine and traditions. Along the way, the essay also endorses
    substantial campaign finance regulation but questions, against Post
    and many others, whether drawing a line between the speech of
    corporations and the speech of natural persons is consistent with
    either free speech doctrine or the soundest underlying
    justifications for a free speech principle.

    A Pima County Superior Court judge has denied an effort by
    Republican Martha McSally's congressional campaign to stop counting
    a group of ballots in Democratic precincts in her hotly contested
    race against Democratic incumbent Ron Barber.

    Superior Court Judge James Marner said that he would not issue a
    temporary restraining order or preliminary injunction to stop the
    count of provisional ballots that were missing a signature from a
    poll worker.

    The race remains extremely tight, with McSally leading Barber by 341
    votes.

    6. Institute a "revolving door"

    those who make more in post-government employment. Leave a Treasury
    job making $150,000 a year to take one in private industry paying
    $750,000, and you'll pay 50% surtax on the $600,000 difference. Most
    of the increased pay is based on knowledge and connections you got
    while on Uncle Sam's dime, so why shouldn't Uncle Sam get a share?
    An Obama veto would be unpopular.

To the extent that many going through the revolving door are working as 
lobbyists or at least in the influence industry, does this interfere 
with First Amendment free speech and petition rights?  I explore the 
question inLobbying, Rent-Seeking, and the 
Constitution<http://papers.ssrn.com/sol3/papers.cfm?abstract_id=1734428>(Stanford 
Law Review). I think Reynolds' proposal would face a serious 
constitutional challenge, and I am kind of surprised that Reynolds, who 
I believe supports the /Citizens United/line of cases striking down 
campaign finance limits on First Amendment grounds, would support this.

    several students posed questions, deriding Perry's views on same-sex
    marriage.

    Emily Sellers '15 asked if Perry would have anal sex in exchange for
    campaign contributions of $102 million, while Timothy Messen '18
    accused the governor of comparing homosexuality to alcoholism.

    Ben Packer '17, who wrote and distributed these and other questions,
    said Perry's views were more insulting than the questions.

    Several members of the audience said they were excited to hear Perry
    speak but offended by the questions.

    Some proponents of municipal election reform advocate for the
    adoption of Instant Runoff Voting (IRV), a method that allows voters
    to rank multiple candidates according to their preferences. Although
    supporters claim that IRV is superior to the traditional
    primary-runoff election system, research on IRV is limited. We
    analyze data taken from images of more than 600,000 ballots cast by
    voters in four recent local elections. We document a problem known
    as ballot "exhaustion," which results in a substantial number of
    votes being discarded in each election. As a result of ballot
    exhaustion, the winner in all four of our cases receives less than a
    majority of the total votes cast, a finding that raises serious
    concerns about IRV and challenges a key argument made by the
    system's proponents.
